is anyone aware of a illegal pdl filing a proof of claim in a ch 13 case? If so, what was the outcome. I know the unsecured creditors only get a few cents on the dollar, so its not much -- its just the principle. Payday Yes via a collection agency to be exact - bloodsuckers! Should notify the NYS attorney general:confused:

I have never heard of it. Are you saying Payday Yes filed a proof of claim? Are you sure it's Payday Yes or Payday loan Yes? Payday Yes is licensed in DE and a few other states, Payday Loan Yes isn't even located in the U.S.

But, Shazzers, payday lending is prohibited in NY, doesn't that make all the lenders illegal in that state?

Its outrageous that an illegal payday lender is going as far as filing a proof of claim. Do you think they have a legal leg to stand?

Pretty sure its Payday Yes, with the collection agency being NCA out of Hutchinson, Kansas. The claim is for almost 50% more of what was actually owed. I will contact the attorney general's office this week and let you know.
