When I finally did reach her, she told me she had tried to call me back several times. I have never received a message from her saying she had returned my call. I told her I was trying to make other arrangements on this check and she said at this point she could not stop it. I told her I had been trying to call all week and could not reach her. She just put me on hold and the next thing I know this guy comes on the phone. I explain everything to him. He tells me their records indicate she has tried to call me back several times. I tell him I have never received a call from her and have no received messages from her. His response is she cannot leave a message when she calls as then they cannot call me back more than once during the day. Okay, then why did she not call me later? He told me the time she had called today and I said that was impossible as I was sitting right there and the phone didn't ring. His response was how did I know something was not wrong with my phone? When I told him I didn't believe she had called, he started accusing me of calling him a liar and became unbelievable difficult. When I tried to talk, he just talked over me. I told him this check will not be good and could I not make arrangemetns for a few days later. He just continued to talk over me and saidthey cannot stop the check. This is very frustrating to me because I have tried to call these people any number of times. I want to make good on this debt but missed several days of work due to illness that I did not get paid for . Obviously, I was not expecting this.
Actually, I have read some very negative things about them on here but up until today, that has not been the case with me. Except for not being able to reach the woman that supposedly handles my account, they have been very nice to deal with. But this guy was off the wall today. He just kept saying over and over again that I was calling him a liar and he was not going to continue the conversation. I told him I wasn't calling him a liar but that I didn't believe she has ever called me. I reiterated my intention to pay tihs debt but I could not do it on this particular day. He asked me why I set it up if I wasn't going ot pay it. I told him I wasn't expecting to be sick.
Since they insist on running the check, I am now going to get an overdraft fee as well.
Is there anything I can do about this guy being so rude?? Unfortunately, I dont think he really broke any laws.

NOOOOO!!!!!!!!!!!! What state are you in? When was the last time you made a payment to the original creditor? Have you made any payments to the debt collector? Depending on what state you are in, I would say put a stop payment on that check ASAP!!!
How many days where the checks post dated for? Did they request it in writing? Did they threaten you if you did not post date a check?
Under the FDCPAct, there are strict limits under which a debt collector can accept a post dated check. In some states, it is actually illegal for them to accept one or even get you to do it.
There could be a good chance the statute of limitations has passed on this, in some state verbally admitting and setting up a payment could restart the SOL but in other states you actually have to make a payment. It may only cost a little to put a stop payment on this check, it is better than the overdraft fees and bad check fees that could come back to haunt you.

I am in Missouri. I am not sure of the last payment to the original creditor but it was either 2002 or 2003. I did admit to them when they first called me that I knew I owed the debt. I guess I was silly in thinking it would just go away.
The bank said they can put a hold on my account. This keep my account from incurring any fees. However, the banking officer does not know what message would then be sent to the collection agency. She is not sure if it states something like "contact customer" or what. What is best? Do I put a stop payment or do I have them put a hold on it? This guy is very nasty so I don't really want to have to go through this with him again. I have already had one check returned to them insufficient several months ago so was trying to keep it from happening again. I would appreciate any help you can give me. Thanks.

5 year statute of limitations on credit cards in your state. Stop that payment ASAP as this debt is time barred!!! Close the account...do anything to be sure they do not get paid.
The reason they where threatening to you is cause the know they can't sue so by doing that it restarts the SOL and then they can sue.
Only a partial payment or written agreement can restart the SOL. If they do not get money from you, you should be fine.
