I got a letter from an attorneys office representing Citi Bank. The name of the office is Allen L. Adkins and Associated, P.C. in Lubbock Texas. I received a letter stating that I owed Citi 9k so I immediately sent a debt validation letter. Guess what I got in return?

A letter from them stating that they did receive my letter but they are advising me of the denial of any inaccuracy regarding my account! And that they had verified this amount with their client Citi. And also that this letter is being supplied as verification of the above referenced info -citi.

Isnt this against the law? Dont they have to provide me with proof that it is my debt? I wasnt expecting this.

Thanks!

Yes, Smiley its definitely not right because, Allen L. Adkins and Associated, will have to provide some kind of proof for the debt you owe.

According to the Fair Debt Collection Practices Act, if the 1 service or collection agency doesn???t validate your debt, they are not entitled to collect payments.

Moreover, if you request for a validation, the collection attorney service or CA should furnish you with certain details such as a written proof which shows that your debt has been sold off or assigned to them.

Along with, that a statement of your account payment history which will help you to ascertain the total debt amount.

On the contrary, the original agreement /account statements from Citi Bank.

If you don???t get adequate proof then you can ask them to remove the collection listing because according to Fair Credit Reporting Act the collectors should not report a negative entry to the Credit Reporting Agencies if they don???t validate the debt. So, ask them to do the needful at the earliest possible.
