I got a call from a Tom Curren (sp?) at 904-721-3711.

I'm certain it's about one of my online payday loans. I am working on the legal ones first, then worrying about the illegal ones, and yesterday one of them sent me an email saying that my case was sent to collections. Then today I got this call....stating he was an investigator, and he was trying his best to get a hold of me. (This was his first call) Then he said there were going to be people coming by my place of work as well as my residences (any last known residences) to speak with me, and I needed to call him back in the Fraud Department.

Anyone else have dealings with this guy?

Just found out they called my sister this morning too, and he said he's been "trying to get a hold of me all day", and they are going to arrest me for check fraud and that I wrote a check to a company in Jacksonville, etc, etc. I dont know if I should call back.

what number comes up on your caller id?this man broke the law in not only stating he was going to have you arrested, but in telling that to another party as well.this is a bottomfeeder.find out the number, and we can help you find out who exactly is calling and any other info to get them a DV letter.do not call him.you can not,and will not be arrested for a pdl.he only wants to threaten you.ah 904-721-3711.that is the scuzz know as UNITED PROCESSING.they are a complete bottomfeeder.send them a DV letter to.

united processing
101 century 21 drive suite 107
jacksonville,fl 32216

send the letter certified mail return receipt.that way you can take legal action against them if they continue the illegalities.

I called back. Big mistake. I said I wanted to know what it was for.

It turns out it's for a company that was a storefront. I guess they sold it off to the debt collection agency? Is that how it works? It was a storefront that hasnt been helpful-- and when I sent them a letter, called me and got nasty and said they didnt need a stupid letter, they needed me to come in and pay NOW.

So, I told him I just wanted to know what it was for, and that he called my sister and that wasnt cool to give my personal information to her, and I didnt appreciate it,-- and that I looked up their company, and they were a debt collection agency, not a law firm.

He interuppted me and screamed "YOU WANNA GET LIPPY WITH ME? I'LL TELL YOU HOW THIS IS GOING TO WORK!!!" and then turned to someone there and said "I'll sign the damn papers, we're taking this bitch in.". And then got back in and said "LET ME TELL YOU WHATS GOING TO HAPPEN. IM SIGNING THESE DAMN PAPERS RIGHT NOW, WE ARE CHARGING YOU WITH A WORTHLESS CHECK AND WITH INTENTIONAL FRAUD!" and then said they had a surveillence video of me going into this store. (Funny, they dont HAVE a video)

I know I wrote the check. Frickin' Duh! But, you cant charge me with worthless check for a PAYDAY LOAN. He wouldnt let me explain anything because he said I was getting smart--- I repeated myself four times "What is the name of the company? What is the name? Hello, will you just tell me the name??" while he was telling his buddy that he was taking "the bitch in".

dv=debt validation.in a sense you are demanding they validate the debt.as well as their right to collect it.there are templates in the do-it-yourself section.you can customize it to your needs.it is important to get that out asap.then if they continue to harrass.then you can take legal action against them.which is more than i can say for them.chances are this storefront sold it to united processing, and they can't validate so they must not contact until they can.also since they won't reveal who they are collecting for that is also a giveaway to me.get the letter out,and watch them dissappear.

Where do these people come from that think screaming idle threats that have no basis or value works... (even my kids are aware that it doesn't change anything and they are young). I would also state in your letter some of the FDCPA regs etc... you know just a friendly reminder.

You know if going to jail actually worked half of the people that are MAKING these calls would be in jail before they would even have a chance to get those of us who "defaulted" on PDL's

It's crazy what they can get away with.

I do have a question though...

What would be the best way to handle the actual debt? I cannot afford it up front, and the actual payday loan place has been really nasty and tells me to call them and come in. Because they have changed their word multiple times, I'm afraid to not have everything documented. I'd happily make payments, but they were refusing payments previously.

Which payday lender is it?

Okay, this payday loan place is really unhelpful. And, in an effort to have all the proof I need to verify I've been trying to set up payments, I sent another certified letter to the payday loan company the same day I sent the collection agency a DV letter.

I have asked for everything in writing, and they absolutely REFUSE to do anything in writing. They will call and leave me nasty voicemails-- the last one I havent even listened to yet because quite frankly, Im tired of checking my voicemail and having to hear their crap. They get nasty and say they dont want a "little letter in the mail", they want me to call them everytime I need them--- even though calling does nothing.

Does anyone have a suggestion on how can I handle them? I want it IN WRITING everything that is going on now, since the debt collectors involved are so nasty, and the PDL loan place is so nasty--- I want everything documented, and signed. Can I just start sending some payments and see how it goes from there?

You need to file complaints with the FTC, BBB and your AG. Keep track of the times you were called, the number and the name of the person calling. Not sure it will stop you from being harassed but the more complaints received about these situations the better the chances of it being investigated increases. Don't speak to them on the phone anymore, just note the number called (it will probably change) and hang up immediately.
