Debt Validation Question

Do you always have to request Debt Validation through a certified letter? What if you speak to the collector (on a recorded call) and request the validation verbally?

I had a collection agency call me (they didn't tell me they were a collection agency or give me the miranda). They girl just bascially said "this is regarding a bally's account and they want to know if you want to settle out of court?"

I told her I would need information and validation on the debt because I would need to check it with my personal records. She was nice about it and said she would send it out.

However, I have had to call their off 2 other times now to follow up regarding the information being mailed to me and both times (on recorder) I have got her admitting to not sending it out yet and that she would send it out right away.

The first conversation with her was Feb 10. I spoke to her for the third time, last night, March 2.

It's obviously been past their 5 day time line of sending out the information upon initial contact with the debtor.

Do you always need to request the validation by certified mail?

Kitty Marie,

Have you looked into your state rules for recording a conversation with a debt collector on the telephone, I suggest you do and hope that it is legal in your state. It is highly recommended and best to have all validation letters requested via certified letter, it is recommended that interaction with collectors be done in written form as opposed to oral form, this will help avoid many headaches in the future.
