I was able to settle with NWC for only principal rather quickly (I paid them using a cashier’s check), but I filed reports asking the AG/DFI to issue a cease and desist order as the relief I am seeking. I’m sure there are many other people in IL getting the shaft from this company. Hopefully, we can prevent this company from taking advantage of people that live in IL (the website claims to be regulated only by DE law, but they don’t offer loans to people in states that have told them to stop, like Colorado and California). Let’s add IL to that list! :twisted:

Yeah, people need to be proactive against illegal payday lenders. I feel people might not have issues against lenders who comply with the state laws, though pdls in general are expensive loans, but it is simply uncalled-for the way these illegal lenders harass consumers. Hope others would also join in your mission to bust one such predator from your state.

Thanks Shazzers! I'm hoping enough people complain to get the AG to take action (the AG has been vigilant in enforcing the Payday Loan Reform Act). I find it interesting that once I mentioned IL law, NWC dropped it's whole "only DE law matters" and agreed to settle with only the amount given, no interest or fees. They are barred from doing business in other states, I really hope enough IL residents complain and ask for the AG to order NWC to cease desist. Let's hope others join me in this!

I'm going to add another thread regarding NWC, I just sent the Delaware AG a complaint, seeking the DE AG to oder NWC to comply with the US 10th Circuit Court of Appeals Quik Cash v Kansas Banking Commissioner so they stop lending in states they're not licensed in. Might be a long shot but it's worth a try (I included the entire PDF court decision with my complaint!

If neither Delaware nor Illinois is in the 10th Circuit, why would the Delaware AG enforce a 10th Circuit decision? Worse, what if they decide to follow the 7th Circuit (which includes Illinois)? The 7th Circuit just decided the Midwest Title Loans case and ruled that Illinois title lenders didn't have to follow Indiana law when they made loans to Indiana residents, even though they were filing liens in Indiana and repo-ing the cars there. Basically, Indiana said the same thing state regulators try when they go after payday lenders. Our borrowers = our laws. The 7th Circuit told them that position violated the U.S. Constitution, at least with title loans. It would be REAL bad if that got extended to payday loans, too.

please do not try to fillibuster around the fact that states like kansas,illinois,and others are finally putting the screws to predatory lenders,and btw that does include internet pdl's.go vent elsewhere pdl mark,because that is all this is a vent by an internet loan mark...GET LOST!!!!!!!!!!!!!!!!

There's a reason Nationwide Cash doesn't offer loans to residents of New Mexico, Colorado, Georgia, Washington, California, West Virginia, New Hampshire, and Pennsylvania, even all their loans "take place in Delaware." They got schooled by several of these states, especially when they were affiliated with Ambassador Financial. They had to move out of New Mexico, hence why they're in DE now.
It would be interesting if the Supreme decides to hear one of these cases or one similar case, but I doubt they will. The commerce clause is a pain, it's been interpreted so many different ways (as if our country still abides by the Constitution any more).

One major difference about the title loan case and IPDs is that the contract is physically made in Illinois, not via the internet. The courts did not rule that online gambling took place in Aruba or the country in which the websites were operating out of and thus not subject to US laws.
