Being sued by HSBC. Help!!!!

I just got served a summons from HSBC. I am being sued for $8,000. It was a stack of papers and not properly concealed and/or in an envelope. Plus, I didn't have to sign for it. It ws just handed to me. So is it legit or is it a scare tactic? How can I tell the difference. It says I have a "case management" scheduled for June 29th, at the local Justice center. I qualify for bankruptcy, so if I go ahead and start the filing process for bankruptcy before that date, will I be ok?

Have never been in this situation before! Scared to death!


You will have to call the court house to see if it is a legal case, there should be a docket number listed on the pages...once you confirm it is yours you have a few options....if it says you need to file an answer within 20 or 30 days, you must do that......you can go on this all your own or you can go to NACA.net and try to get a consumer attorney to do it for you.

If you do file bankruptcy and if this is an unsecured debt, it goes away no matter what....if you file bankruptcy during the lawsuit, the lawsuit must stop and no further action can be taken by them....unless you fail to include this in the bankruptcy.

Do you know the last time you made a payment and what state are you in?
