I was recently served with documents from Suttell & Hammer (formally Suttlell & Associates). I just happended to be eating at my mom's place while being served. I'm currently homeless due to losing both my jobs, a divorce, and other legal matters that have left me struggling to survive. I am using the computer at my local library. I am not working at the moment, and I have not been able to make any payments to my creditors (all my bills have been turned over to a collection agency). I haven't been able to find any type of work because of legal issues.
In the documents they have scheduled a court hearing in Vancouver, WA. I'm not sure exactly what all this legal stuff means, but they want me to sign something...an Order and Subpoena to the Department of Employment Security for the release of information regarding my current employment. LIke I said, I'm not working and I've been living in my car since last October. If I don't sign this document, I will have to go to the scheduled court date, or if I don't go they will issue a bench warrent for my arrest. Can they do this? I have nothing, I have no assets, no money , other than receiving state assistance. Is there anyway I can get some kind of legal advice?...What should I do?

Do you already have a judgement against you? Who is the original creditor? Go to Access Washington on the web and find your way to the courts' web site. You can do a search to see if you already have a case on file/judgement. If you do have a judgement, you'll want to show up for the hearing. You might be able to find info about legal assistance on the web site too. Maybe at the Attorney General's site.

Funny how when the consumers are down on their luck, they end up in your situation, living out of their car and such. But, the banks went crying to daddy and got bailed out. Something is just wrong about that. I mean, really, what is there left for them to take? The air you breathe?

And no, do not worry about an arrest. You can not go to jail for debt. The collectors may threaten it, but that is as far as it goes. Debt is a civil matter, NOT criminal.

If you are arrested you may be put in jail until you appear before the judge. Always best to appear or get an attorney to give you real advice or call the lawyers on the otherside and make a deal but don't ignore a court hearing

while i agree the OP should appear at the coourt date.stating they should get a lawyer is ludicrous.what part of they are homeless and living in their car didn't you get.also what deal does a homeless person make?i suggest going to the hearing and letting the judge know the situation.the OP may get a judgement,but suttel can't enforce it right away.

In agreement with Paul! The old "blood from a turnip" cliche applys here! Also if there is no court appearance in a civil suit the default judgement goes to the plaintiff. There could be a contempt warrant issued but that is not likely!
