Has anyone else settled without going to court?

I also recieved a summons letter from Hanna's office stating that they would garnish my wages if I don't pay. It had several spelling errors and was not professional looking at all. How should I procede? Should I write them and request proof that they are representing Capitol One or should I call Capitol One directly? I'm at a total loss and I'm not going to let these guys get over on me. I will fight it in court if I need to. Has anyone else settled this without going to court? Please help!


I am confused when you say summons letter, have you or are you being sued? Is there a docket number and if so did you check the courts to see if it's real?


If you have not and are not being sued, does the letter have a 30 day disclosure for you to dispute the debt? Does it also say it's from a debt collector at the bottom or anywhere else? If this is the first letter you got from them it should and if you still have less than 30 days, you should dispute with a debt validation letter and send it certified mail return receipt requested,,,,,format this to your needs and do not sign it, just print your name at the bottom. Lastly, what state are you in and do you know the last time a payment was made???????

This letter is being sent to you in response to a notice sent to me on September 30, 20027. Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

It is unreal at how many lawsuits these companies are filing a day. I did a look up on the online court cases in several counties around Marietta and Hanna is filing 10 to 20 lawsuits almost daily. You just figure how many of these get default judgements and look at the easy money they are making. Make sure you answer your summons and don't just let them take your money.
