Capital One calling family members! what to do?
Date: Wed, 03/17/2010 - 21:41
Today, this eveing they contacted my father and told him I owed $XXXXXX. It is unclear whether the cap One rep asked him to pay my debt. Isn't this illegal? He is not even a cosigner on the credit cards!!!! Finding this out makes me wonder what else capital One has tried to do under questonable practices.
Hi Mr. Mud, I think you did the right thing. It's always better
Hi Mr. Mud, I think you did the right thing. It's always better to get everything in writing. Refrain from making disclosed payment unless they are agreeing to the proposal in writing.
Well it doesn't sound good but, Capital One can talk to your father regarding the debt that was incurred by you, even if he is not related or responsible in anyway.

WOW, that doesn't seem legal/right. I thought OCs & CAs can contact family, friends and/or neighbors to get your contact info or leave msg for you, but not allowed to discuss the details of your debt with anyone but you????
The FDCPA prevents collectors who are third party from disclosur
The FDCPA prevents collectors who are third party from disclosure....but I dont think that applies to the OC.
