I received a summons back in September and was looking into bankruptcy but was told I could not proceed due to my income. When I went in, the person advising me on this, told me how to look up my court date online, and it was March 22nd, 2010. So now it is coming up and I am unsure what to do. Should I get representation? What can I expect? Will I be able to negotiate payments in court? I realize I probably waited to long, but it is what it is. I have successfully negotiated my other credit card debts and this one might put me to the point I can't afford. Is there a way to delay my appearance? If anyone can help I would greatly appreciate it, I just need to get a game plan together.

If they get a judgment, they can only take what is allowed by law, most of the tile it is 25% of your income,,,,some states don't allow check garnishment and almost all or probably all states, if you already have a garnishment at the max of say,25% they cannot take anything until that is done......they can take assets if they are not exempt..only if a judgment is entered.

YOu may or may not be able to negotiate a payment, if you go in front of the judge, admit it is yours he will probably see if you and the plaintiff can come up with an agreement or he may just enter a judgment in favor of them.

I don't know what state you are in so it is dificult to say.....that is about all I can give for advice though as I am not an attorney.
