advance credit recovery is threatening to have me arrested

a certain tim stewart from advance credit revovery keeps calling me in my workplace threatening me twice and my supervisor once, that a sheriff is coming over to my place of work to arrest me because of unpaid loan. i took out a payday loan and i was not able to pay the amount back when i lost my regular job (i'm doing part time at present) and right now i'm in extreme financial diffculty. the payday loan company (Payday LOan Yes) turned my acount over to advance credit recovery. these people are so mean to me, especially this person, Stewart. He yells at me and is now threatening me that a sheriff is coming over to my place to have me arrested. is this legal? can they do this even without a court trial? the thing is, when i made the loan, not only did i give them my bank account no. but i also faxed over a copy of a voided check with my signature. please enlighten me on what to do becaue right now theres no way i can pay the 7oo dollars that theysay i owe them, nor the 241 dollars per pay day (every other friday) that they proposed to me.

No it is not legal at all and they can be sued for the threats.....all the threats they make are false, you cannot be arrested.
I don't know much about payday loans,,, hopefully paulmergel responds because it could be an illegal payday loan, where you would only have to pay back what you borrowed, but NOT to the collector, only the lender..You should close that bank account right away if you can.

well for starters both places are illegal in the extreme.two being as paydayloan yes is illegal you only owe the principle borrowed.this orangutan can't have you arrested.if he could he wouldn't be continuosly threatening it.as far as the voided check goes.that means nothing unless it was filled out.i would file a police report for the threats.then file AG,and FTC complaints against both places.try to recall how much was debited by this illegal pdl.take it out of the principle.if the amount debited equals or exceeds the principle you owe nothing.another suggestion is have everyone at your work hang up in this guys face.there you have it fil the report and complaints.then hang up on him as that is wha he deserves.
