Negotiating During a Lawsuit

I am being sued by Capital One. I did not respond for the request for interrogatories they gave me in Oct 09. It is now March 2010. What are the odds the attorneys (Love Beal and Nixon) will negotiate during this lawsuit without filing a motion to compel? I almost think sending an offer to settle without admission of guilt and withdrawal of the lawsuit will just motivate them to ask for a judgement -- regardless of how cleverly worded the settlement offer letter is.

Do attorneys ever negotiate at this point? What should I expect to happen? I am in Oklahoma and owe approx. $6,000, and only have $2000 to offer. What wording do I use to ask them to stop the lawsuit?

Well Guest, I think a response to the interrogatory was very necessary. Did you request for a validation of debt?

If you are able to prove your hardships then you can get some consideration. It's never too late to start anything so, I would suggest you to contact Love Beal and Nixon. But never offer anything first, just listen what they have for you then chalk out a plan accordingly.
