Hi everyone. I was turned over by HSBC to these guys. I made an attempt to call them back and I'll be contacting them tomorrw to talk. I don't have to give them personal info until they validate the debt correct? It was a car loan and my wife lost her job, HSBC of course took the truck and they want the difference..$14k. No way cn I pay that...But unless they validate/put things in writing / dont accept the monthly that I can make they can just sue me and take all m money right?

I want to negoiate with them but I don't see this being a good outcome for me because I can't make $600 a month payments to satisfy. Any suggestions?


DO NOT give personal info even if they do validate....you would pay on your terms by money order, do not give acces to bank accounts, nothing like that.

When was the last time a payment was made and what state are you in?

Yes, they could take you to court and eventually get a judgment against you, but they would have to prove their case first to win......As for what can be taken, that depends on what state you are in....some states don't allow your pay to be garnished, some states, it's 25% of your pay...it all depends,,,,if you have assets not exempt, they can be taken.

Did they send anything in writing to you yet? The first letter you het from them should have a 30 day dispute paragraph,,,,you have to dispute within that time.....once I know your status, I will put up a debt validation letter you can format to your needs to send to them.....send it certified mail return receipt requested.


Also DO NOT call them yet....wait till you answer my questions first and then proceed from there......also from what I hear, leases and auto loans fall under UCC laws and I think all states have a 4 year SOL on that.
