Hello, I've sent a debt verification to a collection agency but the reply came from the OC. I didn't expect that so I'm not sure how to proceed with the CA. Ideas?


Well Mantonucci, debt verification letter won't work for collection agency, it's for the original creditor only. If you are skeptical about the debt the collection agency is claiming, then you can send them a debt validation letter.

Nope.

What does the letter states?

Who is the creditor? How old is the account? Has it been charged off or just been assigned to the collection agency to collect on it?

The creditor is Chase, the account is over 5yrs. old but past due probably around 8 months or more. I don't really know the status as far as being charged off or not, just that it's gone to a collection agency.
The validation letter I wrote was to a company, GC Services, claiming to be collectiing a debt I owe to Chase. The response to that letter was within the 30 days I requested but was from Chase. Their response was, in a nutshell, that they (Chase) were the OC, that the monthly billing statements were proof of my account, the fact I requested a cease and desist of phone calls was a serious matter and could cause problems. (the cease and desist was for the collection agency not Chase and was in regards to phone calls not letters. I was specific)
I wish I could scan the correspondence and post it but I can't, however this is pretty much what they said.
What I'm not really understanding is why Chase is responding as if I wrote to them when I did not. I'm thinking I need to call Chase just for the simple reason of finding out the status of my account so I know who to negogiate with. I guess I was hoping they sold the account but that doesn't appear to be the case.

GC services is working the account 3rd party...this is done under contract which means that Chase will forward all requests to the CA. The only time Chase will become involved is when a DV is sent since they hold the documents. Ceasing the CA will only result in the account being sent to another CA or law office...and could get you sued quicker.
