i called and spoke with some guy named marshall, he said it was for some bad checks for a payday loan, then i said i cannot confirm nor deny what he is talking about and i need something in writing. he asked if an address was correct (which is my old one) and i said no, that i will be sending him a letter to confirm the debt via cert mail and to reply to a po box i will get now. i asked who the lady was and if they are sending somebody to my house, he said "i dont know, we are in new york, not CA" he couldnt even confirm if they faxed paperwork to somebody to serve me some papers. should i be worried? i dont know what to do

Don't be worried at all. That is classic illegal collector activity. For one, collectors don't serve anyone and real process servers don't call you to make an appointment. :)
You will have to give some identifying information like the last four digits of your social. Honestly it is ok to give them your address because by law they HAVE to send you a letter within five days and even if some collector showed up at your house all you have to do is tell them they are trespassing and if they don't leave, call the police...they will get a trespass warning.
Once you can get some info from them (if they even bother sending it) you can check to see if the payday loan is legal in your state and check to see if this collector is legal to collect as well.

yes it is illegal.they won't sue as they have no license to collect.they have to scare money out of people.in fact if you remember when this idiot called then they have 30days to file suit.if they don't then you can sue them.check your state laws in regards to recording calls.that will help in suing them if it comes to that.

I found a street address for them that is also in Amherst.495 Commerce drive,Amherst,NY 14228.They told me the same thing twice.Since when does a process server call to make an appointment.Once you tell them to stop calling you at work,they are suppose to stop.If they don't it may be grounds for harassment. These scare tactics they are using are completely illegal.They need to be stopped.

He said that i was supposed to be served yesterday with papers to apear in court, and also that my sister was going to be served and so was someone else that I know to appear in court about this. The advance loan place is sueing me for $1,821.98, and that i have to pay them. Please help!!! I don't know that to do.

I received a call today from a Michael Belmont stating that he was coming to either my place of employment or my home (never stated which only stated he was coming to serve me). He stated he had been asked to serve me papers on a law suit concerning a check. I asked him information about it and he said I would have to call IAG (International Asset Group) at 877-342-6403. Upon calling them I could have sworn it was the same man that answered there phone and he was quick to tell me to get that out of my head. He asked if I were Michael Belmont and I said no that is who I just stated called me. He asked if I had a case number and I said no he didnt give me one. He then proceeded to transfer me to the Pre-legal department to which the more I asked about the debt with a supposed IMPACT CASH stating it was from 8-29-2008 the less he wanted to answer and after asking for something in writing he stated they would see me when they served me and I would see it then. He then hung up.
I have reported them to the Federal Trade Commission as well as called my Debt Consolidation company I am working with to have them research this issue.

My husband received a very similar phone call, threatening to file suit for an unpaid loan from the same number. I called the number and asked for their website, address, etc. and said I thought this was a scam. He put me on hold and never returned. Later, I called again and no one answered the phone. Unfortunately, my husband gave him a credit card #, which he later canceled the card and called our bank. I am reporting this also to the FTC.

Some guy contacted me Wed and told me that he was going to serve me papers. "For what?" I asked. He then told me that my brother did something and that I was involved in the lawsuit. I kept asking what he did and how I was involved, but the guy was evasive. He was surprised that we "had not gotten an attorney yet," he said. I had no idea what he was talking about. He then gave me a number to call (877-661-2393) and a case number. I called, but they wouldn't give me any info since I wasn't my brother. So I contacted my brother (who is mentally ill) and we did a three-way phone call with Phil Marshall of International Asset Group (IAG), who informed us that my brother had two legal claims against him (one civil and one possibly criminal: bad check and fraud) on a bounced check. He said that the case would be held in XXX County (they know I live in a different state about 1000 miles away from where this is) and Marshall knew how inconcenient this would be. He then said that we could settle the case for the original amount of the check + $420 in attorney's fees and filing fees. After doing research, I then learned that this business is NOT a legal entity but a debt collection agency using what I can only consider illegal tactics to pressure people into paying. My mentally ill brother nearly went off the deep end again with all of this and I am PISSED! I have asked for papers to be mailed out to me in regards to this so called debt.....no papers yet....lol. I also asked for a website since Mr. Dove claimed this was not a scam. He gave me www.payiag.com. This websit is not legit at all. It tells nothing about the company history. Just tell you to basically make a credit card payment. Oh yea James Dove supervisor is John Bus'kay. You may very well receive something different. They got so upset with me they told me not to call anymore just let my attorney call. But yet I owe them $1199.00. Yea right!

I got a call also last from this same company telling me that I have a payday loan out with advance america that has not been paid, a lady by the name of Mrs Carter called me and informed me that I must pay or they will proceed with legal actions, then a guy called me today and said that he was on his way to my home to sever me to go to court from a 9042231026 number I then called that number back and got no answer he did leave a message saying to call a 1877-661-2393 number . She stated that i have a balance on my account for over $2,260 that I owe to advance america I then called advance america and they stated that I only owe $515.00 for the debt.. Im such a fool because I gave this company today $150.00 and set up arrangements for $229.00 a month, I dont know what to do I think im being scammed... Please help

What is this? I am not aware of owing anyone such amounts of money, and I pay all of my bills on time, and even at that my largest payment is my vehicles, but I go to the bank branch in person every month and pay. I have not received any collections letters from anyone?

I received a call from IAG as well saying i owed 1400 for a an old payday loan and that I could settle for 1000 today or else I will be served papers. I told him I didn't believe him and he told me that the person who is serving my papers will contact me. I got a call from a local number (402 area code) and he confirmed that if I didn't make payment arrangements then I would be served either at my place of business or home by the end of the day. I've tried calling the original payday loan place and they said they can't help me cause they sold my bad debt and the number for the place they originally sold it to 4 years ago is now disconnected so i can't confirm if this was valid or not. Has anyone had any legal action taken against them by this place or had the past due balance show as paid on their credit report after paying these people?

She told me that it would be in my best interested to call the collection company and she gave me my case number. Since I called in time, he said the paper work wouldnt be filed against me and that I have to make 4 monthly payments of $311.00. He said that I originally owned $2,500 but was able to bring down the total to $1,200. I gave this guy my debit card information to being the payment process but I feel like a fool since Im reading it happen to you guys also. What should I do? Thanks.

I got a call from International Asset Group and they stated that I owed $1,200.00 for a payday loan that I took out in in 2006 that was $535.00. They stated that if I payed them by the end of the month that they would take $625.00 as a settlement. The lady Ms. Carter was very rude and told me that they were suing me for check fraud and attempting to defraud a federal bank. Now I know they "hot check law" in Texas and I know that the burden of proof is on the prosecution, and that there is no way to prove that someone intentionally meant to not have the funds in their account for the post dated check. I took this payday loan out online and just haven't had the money to pay it back due to other debts and being in school. She continued to say that she would put a 48 hour hold on the account and that I could call back with a decision. I called back and spoke with a Mr. Jeff Crain and he was suppose to send me a DV debt verification letter via email, but he never did. A process server called me today and stated that he was suppose to come and serve me papers today, and all he would give me was the number to IAG and my case number. I called them and spoke with Ms. Carter again and again she was very rude and I ended up talking to another man, not sure of his name, and he said they could settle it for $500.00 if I paid today or tomorrow, but if not they would still do the $625.00 by the end of the month, and that he would put a 24 hour hold on the account so I could make a decision. Now, I now that this whole time they have been breaking FTC laws and various law under Texas Statute, Finance Code, Title 5, Chapter 392. Im not aware of all of the legal aspects, I just did a little research. I do not dispute the fact that I owe for the payday loan, and I want to pay it, I just don't have the means to do it by the end of the month. My question is what should I do about this to buy myself some time, maybe about two more weeks and then I can take the $500.00 settlement amount. Also I was reading somewhere else that it is not wise to send the money via moneygram, that I should send a moneyorder certified mail to them, is this true? I know that they close their books at the end of the month, which is why they are so adament about trying to get their money. Also I called back and asked if they were a collection agency, and I spoke with linda armstrong who stated that they were an investment group and they were a group of paralegal's who do legal paperwork for a group of lawyers... is this accurate? I also asked for the website address and she didn't know it, she put me on hold for about 2 minutes and came back and said they just changed the website and gave me www.payiag.com, which of course gives no information. this is a New York State debt collection "company" , owners are Nelson England and John Chebat. they ARE physically located on Commerce Drive in Amherst, NY, according to investigative reports. they are allegedly using spoof ID to appear as if the number is coming from somewhere close to the debtor, illegally threatening lawsuits and arrests to collect debts, and falsely claim to be process servers. They are currently under investigation by NEW YORK STATE authorities. Please report any complaints to the NYS ATTORNEY GENERAL'S office.

I have not recieved any written communication or calls from this company until about 2 months ago. Threats of serving me with papers if i do not pay, etc. even calling family members and friends (still not sure how they got their numbers, as i did not use them as references on the account). I finally was able to get intouch with them and set up payment arrangements, and have made 2 payments with. For some reason, something told me to research this company and i found this site. They are telling me that i owe 1500 for a 300 loan. I called the "original" loan company and they told me the outstanding balance was 415 (I have already payed 600). should i keep paying them the full amount or what? I am sooo at loss right now, im not sure what to do. is it even leagal for them to charge that much intrest (if it is interest, that is 1200.00 worth)

what state are you in.

I live in Louisiana. the loan was taken out over the internet with cashnet usa. it was for 300. After finding this website and reading all the complaints about this company, i called cashnet and asked what my balance is. the guy i spoke with told me that i owed 415 (interest and late fees) to them but they sold my account to a 3rd party collection agency. he gave me the name and number to the company. i explained to him what was going on, and he told me that i shouldn't pay them anymore. i called the number he gave me and was referred to another collection agency that my account had been sold to once again from them (iag). I called them and explained what my concerns were and asked for something in writing which i havn't gotten to date, and was told that i have an account manager that would not be in until later today and she would have her call me back at the number i provided....havn't heard from them yet. no one else at this company could help me, even though they took my "case number" and put it in the computer, because no one but my account manager has access to my info

well then file the complaints.AG,AND FTC complaints.as long as cashnet sold the debt then you owe nothing as the 600.00 you paid on the loan covers the 300.00 you borrowed.also as stated before IAG is a dirty bottomfeeder that needs to be reported not paid.

My mother-in-law got a call from IAG and they left two messages on her answering machine saying that they were going to serve papers about a debt. I called the number and I asked who they were and what their mailing address was because I believe they had violated the FDCPA by leaving a message and threatening to serve legal action for a debt on someone else's machine and the lady started asking me questions about my identity. I told her that I would like the information I requested first and she said "I don't even feel like helping you anymore!" and hung up the phone. I called back and the second person says they are not a debt collection agency, I asked him if he his company was trying to collect a debt, he said "yes" I said well, you are now acting as a debt collector. He said I was threatening him! I told him I wasn't I just wanted information because I feel my rights have been violated by a third party debt collector. He transferred me to his supervisor who have me the mailing address to a PO Box and I told him I wanted the information so I could send him a cease and desist (sp) letter. My mother-in-law got a call from IAG and they left two messages on her answering machine saying that they were going to serve papers about a debt. I called the number and I asked who they were and what their mailing address was because I believe they had violated the FDCPA by leaving a message and threatening to serve legal action for a debt on someone else's machine and the lady started asking me questions about my identity. I told her that I would like the information I requested first and she said "I don't even feel like helping you anymore!" and hung up the phone. I called back and the second person says they are not a debt collection agency, I asked him if he his company was trying to collect a debt, he said "yes" I said well, you are now acting as a debt collector. He said I was threatening him! I told him I wasn't I just wanted information because I feel my rights have been violated by a third party debt collector. He transferred me to his supervisor who have me the mailing address to a PO Box and I told him I wanted the information so I could send him a cease and desist (sp) letter. I got calls just like I am reading here.... I thought it was a joke and ignored them, however I WAS sued for this so - called bad check claim. I didn't know writing a bad check was against the law.. now no, you cannot go to jail (at least in my state) so whoever told you that is lieing. Crazy, but google it.. you can actually get sued for bad debts as well as authorizing a check that does not clear. Sucks big time, they can eventually garnish your wages too if you ignore the judgement. Hope this helps.

2)an ACH (which cashnet being internet uses)is not a check.

The first UNKNOWN call on 12/14/10 was from Mark (PROCESSOR) Jacobs has called me repeately to inform me that HE will be delivering legal documents, he proivded a number and a case number to inquire about the reason I would be served. After speaking with someone name Shawn Stevenson regarding an outstanding debt, that I could make arrangements to settle the debt, I told him that I needed to research this a little bit more and that I would contact him. He stated that they could put a 24 hold on the action. Ok so after finding out this was a debt collector and their process was illegal, I left him a message to contact me back. Well a week later (12/20) I get the same UNKNOWN call from Mark..same contact number and case number was provided. So I left a message for Shawn to call me again NOTHING. Today (12/21) Mark left me another message,ENOUGH is ENOUGH have file a complaint with the AG of NY and FTC.

Got a call from a woman named Ms. Lucy Cruz. She claims to be a private carrier. When I asked her what this was in regards to she said she had no idea what company/debt this affidavit was related to. I asked her how she got my name and number to call me if she has no idea what's going on. She basically said you asking to many quetions and i don't know the answer. She told me she was scheduled to come to Dallas in a couple of days to serve a bunch of people who were getting sued. The next day I got a voicemail from a Ms. Santiego basically stating the same information that was was going to be served. I decided I would call the 800 number provided by Lucy Cruz and spoke woth a Jessica Oriz. I recorded the phone call. If I do ever get served papers, I'm going to court to fights this illegal group bullying innocment people who have had financial problems in the past. The collector Jessica got so frustreted with me that she hung up.

Do you really own the debt? It would have been better if you would have validated the debt before you started paying it off. Nevertheless, you should contact them immediately and ask them to validate your debt now. If they can't validate your debt, you should stop paying them. Moreover, you can even take legal actions against them. Contact an attorney and he will be the best person to help you in this matter.
