so i got a call from a man named Michael Carter saying that I was being sued for not paying my payday loan. now I havent paid for about a month and I cant even find this payday loans phone number and they dont have a website. Well this man calls me and says im due in court next week unless I can pay $800. and give them a notarized letter that I am auth this deb transaction and that I will not dispute it later. is this real can they really do that. They have left me threatening msg and even called my old job and cursed at one employee.

If someone is really suing you they would know that (a) no one gets a court date in a week (You have to be served with a complaint and have an opportunity to file a response.) and (b) no real lawyer calls to give you one last chance before the court date. These guys all play the same game - get you so rattled that you can't think straight and pay them to just go away. Next time he calls, tell him you look forward to meeting him in court. I guarantee it will never happen.

I've seen alot of great info on this site! Just wondering if someone could give some advice for my situation...I live in the state of Florida and have 3 internet payday loans. They are as follows:

Avantis Financial $400 have paid $80 ( this one had me sign a wage assignment that I signed and faxed back) (address PO Box 774 Sioux Falls, SD )

Integrity Advance LLC(thru iadvancecash.com) $500 have paid nothing yet but will next week (300 Creek View Road Suite 102 Newark, DE)

Community Creit Services Inc.(money2advance.com) $700 have paid $70 (address 42 Reads Way Suite 124 New Castle, DE )

Can you tell me if these companies are legal/illegal? Do I have to follow that staes laws since I live in Florida? They are bleeding me dry! I am about to close my bank acct just so I'll have enough money to live on. I'm thinking of just going into my credit union and just saying that my purse was stollen so that they will have to totally close out the account. What do you think? And also who can I contact to set up a repayment plan that I can afford? Any repitable companies?

Thanks!

I actually received a refund from money2advance(consumer credit service) in the amount of $562.50. I called and asked if they were licensed in CA, I asked for a refund or I would file complaints with the BBB, FTC, CA-Department of Corporations, and the Attorney General.

A lender has to be licensed in CA...otherwise, they are illegal.
