I am being threatened by Paul Martinez at Capital Collections, LLC. I have paid $250 of the $375 that I was told I owe. I missed last payment but sent an email for them to deduct last payment of $125 on 4/26. I also sent a letter requesting that he cease phone voice messages on my work voicemail calling me a scammer and telling me I am going to be sorry now. He sent an email back telling me not to send anymore letters and that I have no rights. He has gone on to say that I am going to be prosecuted for check fraud and that he is going to fax all of my persoanl information to our corporate office, HR, and each and every co worker at my place of employment. I have filed a complaint with FTC. This morning I get to work to find faxes with my name and that I am being investigated for Fraud. How can I stop this? I don't have money for an attorney. I have payments set up on my prepaid visa card and now he tells me that they are going debit $500.
Paul Martinez sends emails saying Ha Ha, you messed up now, you don't want to mess with me, and pay me my money before you become unemployed. He has terrible grammer and writing skills as well.
Can anyone offer any advice or assistance?


You also need to file a complaint with the BBB and your attorney general's office. They are in violation of the FDCPA. First of all, an email does not constitute a proper letter of collection. According to the Fair Debt Collection Practices Act they are required to send you a letter of collection via the mail. If you obtained an Internet payday loan there was no check involved so what they are threatening you with is completely false. You need to make another detailed report with the FTC and your attorney general's office, give them every possible detail you have about this incident, make sure you let them know about the faxes and threats. Also, speak to your employer and tell them you are being threatened and harassed by a collection agency who is violating the federal law. Fax them back a cease and desist contact letter, that is your right. However, obviously, if they are violating so many more of the the FDCPA laws they will most likely ignore the cease and desist letter. The less you talk to these people the better off you will be, the more you talk to them the more they will call, what they want is someone to argue with, don't give them that. Just make sure you tell them they are violating the FDCPA by NOT sending you a letter of collection via the mail, they are required to do this within five days of their first initial contact with you, then hang up and do not speak to them again.

I only owe him 80 more dollars and he had 15 different guys call my place of employment non-stop. He said he wouldnt stop calling until it was paid. Absolutely ridiculous, he called my mother and my job stating that I was a criminal and going to jail for my 250 dollar debt. This guy needs to be stopped. I googled his name (Paul Martinez)and capital collection and everything you read is complaints. Why hasnt the BBB or someone done something about this? I even acknowledged my debt and said I would work with him to pay it back, and every payday "all day" he calls until I get my check and make a payment.
