Garnish Wages for Old Debt
Date: Wed, 04/07/2010 - 12:06
Hello... I had a so call atty call my exhusband last night and left a message for me to cal hime back stating that I was in trouble and needed to call him NOW, and pay off this debt of $3000. I did call to find out what he was talking about and come to find out he was trying to collect a debt that I am not even sure if it belongs to me. Then When I explained I am a single mom, and a Full time college student working to pay bills and support my daughter, he stated "thats not important". He was rude and pushy. I asked for proof this debt belonged to me from 4/2000. He would give it to me. Then he said the SOL is about to run out and they will ganish my wages or take my tax return. I told him if it does belong to me, send me the information and I will pay what I can afford in montly payments. He wanted $900 now and $50 a month. Like I have that sitting in the bank to just send. But My question is, Can they garnish my wages or take my taxes without even sending me information about the debt. I am in the process of paying some OLD debt off now, in monthly payments, but I was sent information pertaining to it, and have no problems paying my own debt. This guys was a so call atty with Law Ofiices of Lawrence Hecker, Mr Derosa.
I would tell him lets talk when the SOL runs out. Most likely it
I would tell him lets talk when the SOL runs out. Most likely it is a purchased debt that they are trying to squeeze what ever they can get before it is useless. If you offer him $500.00 he would take it. I personally wouldn't give him diddly squat.
He would have to take you to court first before he could garnish
He would have to take you to court first before he could garnish your wages. Secondly, only federal debts can put leins on tax returns.
