Hello, Greenlight payday loan company is illegal in Calif.? I had a payday loan with them. I closed my bank account to take back control of my money.
Now Greenlight is threating me with a wage Garnishment. If they are not legal how can they do that. In the contract is says garnishment not assesment.

Wouldn't they have to take me to court for a wage garnishment?
I still owe on the princeple and going to start making payments to Greenlight.

Thanks for any help.

If you have signed the voluntary wage assignment form, they can present it to your place of employment and get your wage garnished. However, it can be revoked any time.

I couldn't find the licensing details of Greenlight Payday when I searched them in the following site, which may mean that they are illegal. But, California also follows the CSO model. Hence, you may check them out with the Secretary of State's office as the CSOs are required to register there.

I just wanted to clarify something, a 'wage assignment' is usually included in the contract for a payday loan, it's an agreement between borrower and lenders that reads if the borrower defaults on the loan you give them permission to attach your wages, legally, you have a right to revoke the wage assignment at any time, so shoot them an email and revoke their right to use the wage assignment, date it, then print it out and take it to your employer.

A 'garnishment' must be sought in a court of law, so, they would need to go to court to obtain a judgment against you first and since they aren't licensed, they wouldn't dare walk into a court of law. CLICK HERE to find out how to deal with illegal lenders.
