If CashnetUSa is a legal payday loan and sold the loan to a debt buyer named M. Callaghan and Associates am I obligated to pay them? They are not licensed in Minnesota to collect but I was told by the Minnesota dept of commerce they didn't need to be. I am sending a debt validation letter certified with return receipt but just want to know if I have to pay them or make arrangements with them in the future. They bare a debt buyer co.


If the lender is legal in your state then they can charge all the fees and interest legally.

Regarding the licensing status of the collection agency, some states do not require the CAs to obtain license to perform their businesses in the state. But you may still send a DV to the CA to confirm that they have legal rights to collect on the account.

I received no letter just phone calls and they don't leave company name just personal name and threatening with drivers lic. and SS. They are calling my work now.
People on the collections forum said M. Calligan and Assoc.
were bottomfeeders and not to give them any money.
I don't know what to do now.

They can't have your driver's licensed revoked, the threats are empty. Next time they call, tell them they have 5 days after their first initial contact with you to send you a letter of collection via the mail, that's a federal law (FDCPA), don't speak to them again until (and if which I doubt) you receive that letter of collection thru the mail.
