I live in Indiana. I currently have a payday loan through Advance America (Store Front) for about 300 dollars. It is coming due this Tuesday and I have no way of paying it off or even mustering the 75 dollars for the payment option due to a series of unfortunate incidents. My bank has a tendency of paying checks even into negative amounts. I have every intention of paying this loan off as I do make good on my debts. Would it be looked at as intentionally defrauding Advance America if I were to stop payment on the check I wrote Advance America and offer them payments in a week or two to settle up with them?

Instead, why don't you go in and sign up for the EPP (extended payment plan), Advance America is a member of the CFSA (Community Financial Services Association of Americ), see the link below for the member list:

You must go into the store and request the EPP at least one day before it comes due so you still have time to sign up for it, go in first thing tomorrow, it will save you a boat load of interest. Read the link below to see how the EPP works!

The EPP would cost me 75 dollars which I don't have currently. That was my initial thought but due to forgetting about a couple automatic payments I had set up I had a slew of stuff bounce this past Friday. Needless to say after I got through the pile o' NSF fees I was fortunately able to get my checking account back in the green if just barely. As it stands now as long as I don't do frivolous things like eat this coming week I will have just enough to put the stop payment on the Payday loan check. However, if I can figure out a way to do the EPP that will be my first option.
