If I owe money and have failed to pay and a suit has been filed against me but no judgement can I avoid the debt if I file BK?

IMO you should first try to see if you can payoff the debt. Bankruptcy isn't an option to avoid paying off your debt. You would need to meet the eligibility criteria to be able to qualify for BK. And the Bankruptcy Abuse Prevention Act of 2005 has made the criteria stricter.

it really depends on the type of debt. some debts cant be disharged in bk. like child support payments, taxes, and student loans. if it is an option you are considering talk to an attorney.
