Today I received a voice mail from a Hal Jordan from NRS wanting to inform me of what would be "taking place today". He also called my cousin at his mother in-laws house looking for me. When I called him back he was cordial at first, but in so many words said that there would be legal action taken against me in my state (Hawaii) because of a payday loan with Cash Central that I "ripped off". That I used my bank account to defraud this company because I had bounced checks to them and the last time they tried to take money from my account it was closed. He said in so many words that I was a criminal and their job was to investigate weather I acted intentionally to commit this crime and since I did not pay the loan back, I was committing a crime. I asked how much was I owed to Cash Central because I wanted to deal with them directly to pay off this debt, he said that I took out a 300 loan and now its up to 600. If I didn't provide him with proof of a money gram payment to Noble Recovery Services within 1 hour, then they would attach their attorney fees and my bill would be 1200 after. I tried to explain my situation and that because I lost my job and other situations, my checking account was overdrawn and eventually closed by the bank because I didn't have the money to make up for the negative balance. I told him that I wanted to repay the debt but he wasn't willing to work out anything with me. He basically said that if I frauded the company and legal action will be taken on me unless I showed that I returned the money which was 600 whithin 1 hour of our conversation.

I called Cash Central and was told that my account was sold to a company named MLA Holdings. I tried calling, but cannot get a hold of an actual person.

What legal action can Noble Recover take against me? He says that they can take action because of my bounced checks. I have a lot of debt and am going to file bankruptcy as soon as I get the retainer money together for an attorney. But what can I do in the mean time?

In a nutshell, none.

Do not spend one further nanosecond of your time explaining yourself or trying to negotiate with these people. He has already violated FDCPA laws by implying that criminal charges would be brought. Defaulting on a loan and going broke is not a criminal action, in any state... and I assume these were post-dated checks left as security on a payday loan? In that case, in order to press check fraud charges, they would have to PROVE that you wrote those post-dated checks with the full knowledge that the money would not be in the account on the deposit date.

By law, they are required to send you a collection letter within 5 days of contacting you. And then, also by law, you have 30 days in which to dispute the validity of the debt. By calling you and setting a deadline of less than 30 days "or else", they have effectively denied you that 30 days. Another set of FDCPA violations right there.

So, next time this guy calls, simply tell him that you need a collection letter mailed to you immediately, and also get an address of the CA so you can send them a letter via Certified mail requesting Debt Validation. He may refuse one or both of these things, at which point he has buried himself so deep that they won't have a leg to stand on in court... and you can feel free to ignore him.

They're calling again today and I'm just scared to talk to the guy and get sucked into his whole badgering me that I'm a criminal. Does anyone know any info on this Noble Recovery Services in Anaheim? When I called Cash Central the original PDL company, they said that another company, MLA Holdings purchased the account. How do I know if this Noble Recovery Systems is actually collecting for MLA? I'm wondering how they even got my cousin's mother in-laws number! Yesterday he was saying that they had authorization to investigage my properties, which I have none, my friends, family, CIA file.....this was all very scary. What can I do to get them to stop calling everyone? I've never received written communication from these people.

Don't know about getting into CIA files, but all he did was threaten to look at some skiptrace software which basically pulls together public records, i.e., real estate you own, who your neighbors are, what kind of car you have registered, etc. Essentially, the same things you could find out about anyone with a few hours to spend on the internet. His game is to make it seem like he has some special mojo and top secret legal authority to scare you into paying.

Having said all that, Cash Central is a licensed lender so anyone who buys there loans steps into their shoes as far as being able to sue you. Doesn't mean they get to add interest or fees (since the buyer isn't a licensed lender) or harass you in violation of the FDCPA. But you might consider telling the guy you have a certain amount of money your willing to pay to settle it and that's it. Basically call his bluff. Nobel has no history of suing anybody (I can check public records, too . . .) so you shouldn't really have much to fear.

Oh God, don't even worry about this guy, he's a lowlife bully. Write them a letter, send it registered, to all the addresses, and tell them they are not allowed to contact you at work. List, chronologically as best you can, all of the contacts you've had and how they've violated the Fair Credit law. When you read the Fair Credit text you'll see just how abusive they've been. According to the Better Business Bureau, the Upland, CA address is no longer valid, but I sent a copy of my letter to it just to be safe.

I called once and asked for a fax number, and Hal Jordan said, "I'm not giving you our fax number so you can just fax a 'cease and desist'." He actually refused to give me the fax number!!!

NEVER be afraid to talk to a debt collector. You have the right to tell them to not call you.

Do a search in the box above! There is a wealth of information about them! All saying they are a smoke blowing bunch of idiots who accept getting sued as part of the cost of doing business! They even post on here pretending to be people who have gotten sued! Just ignore them! They are not licensed anywhere except maybe California! They use the same lame tactics on everyone!
