I had gotten a 'Complaint' from Zwicker 'representing' Chase Bank a few months back for 'breach of contract', answered the questions, sent the info back to the courts (certified to make sure recieved)
Then about 2 months later recieved another one that was an exact duplicate, just with the dates crossed off(seriously, crossed off) and changed to current dates. Then a few days later, got another 'Motion for Default Judgement' with the same Docket Number. I contacted the Courts and they said they didnt see any hearing for me on that date.
Also, the court they submitted to is in the city, I live in a surrounding county.
They lumped the 3 accounts together totalling(after all those late fees, etc of course) $26,500. Also, one of the accounts was purchased by Chase, so, I did not sign a 'contract' with Chase on a $3,000 account. Does anyone have any suggestions on how to handle these people? I know I dont have enough to settle even at 50%, but maybe can make a payment plan with them or something. Not sure what to do. Cant handle any more than 500 a month. Anyone?? Thanks!

Sounds goofy, you should get a free consult with a lawyer in your area that can explain exactly whats going on. None of it sounds good. You mentioned Chase purchasing an account, are you referring to perhaps a wamu or providian card? Chase took over both of those. The motion for default isn't good, I'd double check with the court regarding scheduling because sometimes they'll mail the stuff out and it can take a couple days to hit the system...Step 1 get consult so you don't get stomped, then update. Personally, I'd pull the arbitration card to get this stuff removed outta court. Unless of course you don't owe the $...

this is how they get default judgements.first motion to move the case to your county because as it stands now.any judgement can be vacated for improper venue.also keep up with this through your court clerk.anytime zwicker has gotten a judgement it's been by default.fill out those new forms the same way as the other ones.again motion to eother move the suit or dismiss due to improper venue.then fill out the papers just the same as before.keep tabs through the courts,do not trust zwicker at all.in fact NY AG cuomo is getting hundreds of defaults vacated due to the fact they manipulated the process server.never trust them.
