Serious Threats

First of all, you need to go to your human resources department and inform them about what is going on. If you have a good relationship with your supervisor, pull him or her aside, let them know what has been going on, and ask them to inform the caller that collection calls are not permitted during work hours. Second, what they are doing is a classic scare tactic that many payday lenders use to try to get the money. They cannot come to your work and arrest you. They may tell your employer, but if you have already informed your employer and let them know that they are wrongfully harrassing you, your employer should be able to get them to back off and if the company refuses, you may have grounds to go to the attorney general's office in your state and file charges against them. Do not buy into their drivel because all it is that they are feeding you is crap. Besides, if you were really going to be arrested, why in the world would they warn you? Most people that I've known to get arrested generally are not warned for fear of flight. Talk to your employer and try not to let this get to you. Change your phone numbers and talk to your attorney general, but as an afterthought, you have the right to send a certified letter to the company (by mail, of course) stating that you are envoking your right to refuse any communications other than mail, at your home, place of employment, etc. This way, you have proof that you sent a request to be left alone and if they fail to do so, they are the ones who will be paying, not you. So, please don't worry and know that you are not the first to go through this kind of scam.

This is a common scare tactic used by illegal payday lenders. If you have a letter stating the account is paid in full, tell them so and tell them to stop calling you. If they call again, hang up. You can't be arrested for defaulting on a loan, especially an ILLEGAL one.
Do a search on this forum and you'll find a lot of information. This has happened to a lot of people (including me). Don't let them scare you.

Just curious, what was the name of the Payday loan company you had the loan with? It's more than likely one that many of us here have dealt with. Don't admit to owing anyone money - If they call you again, tell them you want something in writing on company letterhead stating what you owe, who the loan was with, and that in fact you DO owe a legal debt. (aren't PDL's illegal in NY, anyhow?) I'm willing to bet you'll never, ever get a letter from them. And I'm also willing to bet that they're using a bogus US phone number and more than likely aren't even physically located in the United States. I had one of these outfits call me and say they were going to see me in a British court of law; I told them to come on over, I'd be waiting for them! If you have any other questions, please come back here and ask, there's lots of people here who've been through the same thing.

This is my worst nightmare. First, they are breaking US law by calling you at work when you've told them not to. So, you are on the right side of the law. They can contact your employer but if they won't produce paperwork for you, they certainly won't for an HR department who are certainly going to demand it from them. I would file a harrassment claim with the attorney general of your state. Get it on record. Don't let them scare you. You paid your loan. They are more than likely located overseas and couldn't actually harm you if they wanted to. Talk to your HR department and tell them honestly what's going on. They may have advice for you. You are being victimized at work and you need their help.
This sounds like......

I don't have an attorney and told them that. I was read a 'citation' stating they are seeking over $5,000 from me because of bank fraud, wire fraud and also that I will be serving jail time. How can they do this to me? I haven't done anything wrong. I had one payday loan that I defaulted on for 1 month, but have paid it in full and have a letter to prove it's paid in full. Please help me! I am puking I'm so worried and can't sleep at night. Their number is 315-508-3158. Can they tell my employer? Can they come to my work and arrest me? |
This sounds like the "Indian speaking" threats that have been going around for quite a while now. They make these empty threats just to see who they can scare into sending them money. They will call my phone every ferw months, they'll even call my office. They will not stop. They are in California then Miami, just temporary lines from out of the country. Do not worry about them if they refuse to send you the verifications. Ligitament companies would want to send you the information.
Just think of how many people are actually scared into sending them money.
Remember, no verfication on their end, no verification on your end. Do not give them any personal information. They will even give you your last 4 digits of your social - they don't have the rest. They will try to get that from you.
Don't worry - until you see letterhead.
