Not sure where to start but here it goes. I had a car repossesed in 2008, loan was with Toyota. I now owe $6,327.13 after car was auctioned. I am a single mother and it is very hard to come up with any extra money after living expenses, but I do want to attempt to try and pay my debt. Now I have Simm Assoc. calling me saying they are going to my payroll dept. and are going to deduct my wages. Can they do this without taking me to court? Also yesterday I had called to see what they would give me as far as options and the original person that had called me was not in, they gave me to another agent and he said to offer them what I think I could offord, be it $1,700 or $1,000. Is that a smart move? Thank you in advance for any advise on this.

They need a court order to garnish your wages. The fact they said this would make me very leery. Send them a debt validation letter, make sure they are the legal ones to collect and make sure they are collecting the correct amount.
If they do sue you, you can take all your financial info with you and the judge will set you up on a payment plan you can afford.
Also if they sue you and didn't validate, you can counter sue for continued collection activity.
