My husband took a small loan from the pdl company lakota cash. He received something in the mail today that this company is going to garnish his wages starting next friday (4/23/10) which is his next payday. This was a letter from his employer letting him know about the garnishment. My question is this... we currently live in North Carolina and I thought NC was a non garnishment state. Also we never received any kind of court order or judgement from any court for this garnishment. Is this legal? What can we do to stop this. My husband is the only one working in a household of 5 and the garnishment is 25% percent of his pay...HELP

first give your HR person a WAGE ASSIGNMENT REVOCATION letter.then give them a copy of the pdl laws in NC.basically not only is NC a non-garnishment state, but pdl's are totally prohibited.this should not be happening, and your employer should know this about granishments.
