What happens when a debt collectors calls and says you have old debt from over 10yrs. ago. You believe you already paid it off but dont have the documents stating this. it doesnt show on my credit reports, but they say it doesnt matter you still have to pay? what do i do?


Without written proof that you paid the debt it is going to be difficult to prove that you really did pay it. Unfortunately, the creditor, and the court if the creditor decided to file a collections action, are not going to take your word that you paid off the debt. One thing you could try, and is not guaranteed to work, would be to call the collection agency and try and get the name of the creditor who assigned the debt and talk to the creditor. But the best advice I can give is to talk to a collections lawyer in your state.

You dont need a 1...you can do it yourself. First send a DV letter..make them prove you owe the debt. Secondly...when was the last payment made? It may well be out of SOL for your state and no longer legally enforceable....if out of SOL you simply send a letter telling them to FOAD and to never contact you again.
