Capital One Ruined Ruined My Credit

When I was 17 my mom added me to her credit card to help build my credit. It was also because back then she paid for my gas and it was easier to pay for it that way. At the time she had good credit but now she has not paid the credit card payments in a long time and it's been closed and sent to Suttell and Hammer debt collectors.

The problem is I was told I was removed from this card years ago and had no idea my name was still on the card. Until the other day when I tried to get a personal loan from my credit union and they denied me because of the capital one business even though I just paid off a smaller loan from them 6 months early and never missed a payment and also have a credit card through them in good standings.

When I was put on the credit card I was a minor and never signed anything. My mom basically just said,"I'm putting you on my card to help you out." I was supposed to be removed when I turned 18 because I started paying for my own gas and insurance.

Now I'm trying to get this problem fixed. My credit score is 609. I've written up letters to 2 of the credit bureaus after getting my credit reports and finding that Experian does not show anything on the capital one card. I'm trying to figure out where to send a letter to capital one because they won't answer any questions on the card. They just give me Suttel and Hammer's number and don't have their address. I have a feeling Suttle and Hammer is not going to help me out and I don't want to call them because their automated voice system told me they'd use any info they get from me to collect the debt and that means they're going to call my cell all the time and harrass me. So I hung up.

My question is, where do I go from here? Is there a way to contact the debt collector by mail and if so, will it do me any good?

Any help is greatly appreciated!

Here you go. I would first try disputing with the credit bureaus before making contact with the icky goo below.

The only thing disputing with credit bureaus, is they will put a dispute notice in your file, say they investigated, and it's yours, type of thing.

Has Suttle & Hammer PS sent you and/or your mom any letter, they've been retained by Capital One? I do have a couple of letters, I used, if you are interested, that may help you out.

I am very familiar with the Fair Debt Collection Practices Act (Debt Collectors - Collection Agencies), and help people out with Collection Agency problems. I am not an Attorney, nor have I had any formal Legal Training, yet. Do you have any document like the credit report or any letter that proves that your account has been sold to Suttle & Hammer? If not, then you can send a debt validation letter to the CA via certified mail return receipt. According to the law,the collection agency should sent you a reply within 5 days after receiving the letter.

If the CA don't reply, then you can dispute the debt with the credit bureaus. Attach copies of all the relevant documents that will help you to prove that you tried to contact them but they refused.

I have just recieved a Summons from a Wa court & it was initiated by Suttle & Hammer. I never recieved a letter that they bought the old debt just this summons. I researched & realize I must respond so I am doing that. I have only a small disability income and have been paying other debts that were cooperative and put me on a reduced paymt plan without % but HSBC was not cooperative and only demanded full payment 5 yrs ago. I was not then nor am I now able to pay. It is my understanding that since I'm on disability that my income can not be touched. If it comes to me having to go to court does anyone know what I can expect as far as proceedings?

one thing to do 1st is to check with the court that a summons is said to be filed in and see if it truely has been filed. A Summons that is truely filed will have a case # and will be stamped by the court clerk on the front page. Many collection agency's send out real documents claiming they have filed with the court when they have not. If your summons has no case # then u can send a Cease and Desist letter and stop them from contacting u anymore. Then most likely the case will be sold to yet another collections agency and u are now on the merry-go-round of sending cease and desist letters for 7 yrs until the debt is no longer valid. U can find cease and desist letter forms on the internet or make ur own but the wording must be correct. Good luck.
