Some collection agency called and said my loan from Everest Cash advance was sold and that they were going to file court proceedings. I have already sent letter to Everest telling them loan is illegal in PA. I told collection agency that they could not call me at work and that the loan was illegal. Should I worry about court proceedings?


I wouldn't be too concerned. Next time they call tell them they are required by federal law (FDCPA) to send you a dunning letter (letter of collection) in the mail within 5 days of their first initial contact with you, also tell them you are counting those days and if you do not receive a letter of collection you are prepared to file complaints against them with the FTC, BBB and your AG for not complying. I would also let them know you will be keeping records of each and every communication with them just in case you decide to sue them for violating your rights and the FDCPA. And please follow through !
