I got a call from a "Max Hall" with United States Affidavit & Investigation Services. He told me that he needed to verify information with me regarding my upcoming court case. Since he said all of this as though I should know all about it and I didn't, I said "what court case?" He then went on to ask had my attorney not briefed me on the case? I told him that I was unaware of any case, so no, I had not been "briefed" on anything, what was this about. "Max" (who sounded no more like a Max than Oprah) went on to tell me that I was named as a defendant in a lawsuit. I asked him what it was about and he told me that he needed to verify personal information and that they would then send me the papers on this case. I told him that since I don't give out personal information on the phone, he would just have to send whatever he has to my address, which he should have if he is suing me, and I would contact him then. I told him to have a good day and I hung up.
A few seconds later, my phone rang. Same number. I did not answer. I let it go to voicemail and planned to check it when I got to the office, since I was driving (all of this was on my cell phone). Within five minutes, my phone rang again and this time it was my grandmother. She told me that this guy that she had a hard time understanding had called her. He had a really thick accent and told her that this was a legal matter and I was going to be named in a lawsuit and that I needed to call him right away. I told her that I had just talked to this guy, but I would be calling him back. I told her that this was probably a scam since he wanted my personal information. I told her if he called back just tell him stop calling and hang up the phone. For the love of all that is good, don't verify anything with him.
I was back at the office by this time and I wrote down the information that "Max" had left on my voicemail. I did a google search for the name of the company and everything that I found pointed towards this being a scam where they trick you into giving them permission to take money from you so that you don't get named in a "lawsuit" because of a bill that was unpaid. Usually an internet payday loan. I also did a reverse phone number lookup and found that the number was not listed, so I was pretty sure this was no government office as the name may imply.
I called the number that had been left and I asked for "Max Hall". He was not available, but "Ray Fleck" (who, btw, sounded just like Max) was happy to take my call. He told me that I was being named in an upcoming lawsuit and I needed to verify my information with him. He rattled off my social security number but I refused to verify it. I told him that I would not verify information over the phone that he would need to mail it to me. I asked him where the debt was and he told me that it was a loan that I took out with U.S. Paydayadvance, which I told him I have never done business with, ever. He told me that I could just "F* Off then!) and hung up the phone.
Well that really ticked me off. I had his number so I dialed him right up. I told him that 1. I did not talk to him with that language and 2. NO ONE will talk to me that way. He told me he just wanted my lawyers fax number so he could fax the information to my lawyer. I told him that since this was a bogus debt and I could prove it myself, I would represent myself and he could just fax it to me and here is the number. He would not take the number and told me that he could only send to my lawyer. I told him that was B.S., if it has my name on it he can fax it to whoever I tell him to. He told me that no, he wouldn't, and I could just wait on a summons to come in the mail. I told him that they don't send a summons by mail, did he not know that? He answered "oh really? and where is that?" I told him "anywhere in the united states" and I asked him where the heck was he from? He hung up on me and I haven't heard anything from him since.
In the meantime, I found this place and it is a God send. I would have paid off all of the loans I have, but since they are going to be greedy and try to scam me, I am not going to pay anything that I don't legally have to. I intend to pay the one lender that is licensed in my state, which is IL. Here are the others that I have, what I have paid, what the original loan was for:

I have already closed my bank account. I am sending out the ACH revocation letters today, and I will also be sending out the wage attachment revocation letters today. I am going to speak to my credit union about putting an ACH block on my account. Is there more that I need to do at this point? I want to do this right, and I can't beleive when I look at this that I was so stupid. I will never get myself in this shape again!! I am hoping that this can serve as help to someone else who may have made similar mistakes. What else do I need to do? Any help appreciated, and thank you all so much!:confused:

Please please please file a complaint with the Attorney General???s office for the outrageous and ILLEGAL loan term with nationwidecash.com!! I have filed a complaint seeking the AG to order NWC to either obey IL law or quit offering loans to IL residents. Under the Payday Loan Reform Act of 2005, the most Nationwidecash could have charged you was $346.50, and the AG might help you get a refund you are entitled to! PM me and I can more info! I will contact them directly and give them the chance to settle this, and pending the answer I get, decide what I need to do next. I do think the only honorable thing to do is to report them in either instance. If they hoodwinked me, they will do it again to someone else.

just know this.since every loan,but cashnet is illegal.you pay the ones you owe on your terms.it looks like your spouse is entitled to a refund on like loans.(cashjar,ameriloan)have you spouse push for refunds on those two,or better yet try to get a PIF on yours as it looks like if you combined the loans you both got at the same places.you overpaid.that way the only loans you owe are.

I wondered if it would be possible to combine the two loans at the same place. I thought it should be, but I am pretty sure the loan companies will think otherwise. I have got the paperwork ready to send in for Nationwide and I will be getting the others together. CashNetUSA has been pretty decent to deal with so far, which is not surprising since they have been the best to deal with from the start. I have the info to do moneygram for them. The others are getting 20-25 per payday and that is that. Even then, only if they will give me moneygram info. If they won't tell me where to send the payments, I guess I can't send them unless I mail a money order. Suppose that is possible. You guys have been great, and I can't thank you enough!

You could try to combine the loans if they were paid from the same account. You could argue that even though they are seperate that funds were from the same account and because of that you or your spouse have over paid so you want that overpayment applied to the other loan. It is worth a shot.

Well, here is an update. I got a paid in full letter from PDL Ventures today via e-mail, so I can mark that one off the list! Almost creepy that it was that easy. I printed that one out and I will put it in my file, becase as we all know documentation is everything.
I remember being told in debate class that the court case isn't won by the lawyer with the best argument, but the one with the best documentation. Seems truer every day.
I will keep you posted on how the rest turns out.
