I am currently in a chapter 13 bankruptcy but made the mistake of taking a couple of payday loans that I am having trouble paying off, any advice?


As far as the online payday loans are concerned let me tell you that they are not licensed in the state of borrower and that's the reason why they keep on charging their high rate of interest which keeps on increasing every month. So,even if you increase your monthly payments in order to get rid off your debts, you will see that your entire payment is going towards their illegal fees and that's the time when you feel that it is impossible for an individual to get rid off these online payday loans. I would suggest you to go for a debt settlement program and consolidate all these online payday loans under one single monthly payment according to your Financial situation.

Not good advice! Settlement is not consolidation first off! They are two different things! Debt settlement and debt consolidation companies generally will not deal with PDLs and vice versa! Also most debt settlement and consolidation companies have minimum debt figures of 5000.00 toal debt or more before you can get into the program! I'm sorry to disagree!! There are different Debt Settlement companies that deals in PDLs and moreover they do not need your minimum debt amount to be $5,000 in order to work on your debts. They can not only work on your debts, they can also help you to pay them off at the earliest and lead a Debt-Free life in the near future. So Debt Settlement is always one of the best options especially when one is dealing with PDLs.

Debt settlement is detrimental to your credit score and is a poor way of dealing with payday lenders! Most PDLs are illegal and will not deal with any settlement company! I know this from my own experience and my years on this forum! Consolidation is a better option but only for large debt! A few little PDLs can be paid off easily or probably in this case are legally paid off already! Those that are legal will usually work out a plan with the creditor, per association rules, without having to pay up front fees and buried ones that are common with settlement companies! Most settlement companies, but not all, are bad news and strictly out for profit! This forum is full of horror stories of money spent and nothing went to the lender! I say beware!

I have a gut feeling that you and the other person are either the same or work for the same company! Lets see if your IP addresses match! Whatever you are offering very poor advice! PDLs sell quickly to Debt buyers when collecting becomes difficult! Debt buyers do report to the CAs. The best way to get rid of them is to pay them what your state laws require and not a penny more!

This is very bad advice to the OP. Frogpatch is absolutely right. If you truly want to get rid of your PDLs, share with us your details (e.g. which PDL companies do you owe? how much did you borrow? how much have you paid thus far (not what they SAY you've paid toward principle, but how much you've actually paid)? What state are you in? Were these storefront or internet PDLs? Are they actually PDLs or CSOs?)

Many times, in the case of internet PDLs especially, you're dealing with an illegal lender whom you've already overpaid. I was even able to get some money refunded to me from some of these bottom feeders.

Share your details and, I promise you, you will get some great advice from the people of this forum.

Thanks for your support Ohiogal! PDLs will not work with settlement and will turn you over to a collector on the first appearance of a settlement company! With the exception of a few they will not work with anyone! Also as I said, most settlement companies will not bother with small debt unless they are desperate for business!

Can somebody tell me what the laws are when a PDL collector (Hendrick Joseph and Associates) leaves a voice mail at my cell and at the voice mail of a coworker that has the same first name as I do and states that I have commited a Federal crime and that if I don't contact them by 2 p.m. they will come and arrest me. I know this is not true, but I am upset they left such a message on the voice mail of someone they assumed was me. Isn't this just like they were discussing my personal business with someone other than myself without my authorization - what are my recourses?

hi YennyV6 according to the fdcpa act they have violated the law,you can file a complaint with your local attorney and the ftc you should also put a complaint against them with the bbb.You may want to look up 15 USC 1692b 804. Acquisition of location information and 15 USC 1692c 805. Communication in connection with debt collection, for the details of this violation .These payday loans companies just wont abide by the law they should be banned but then thats just my personal opinion. I HAD THE SAME PROBLEM I DIDNT PAY BACK A INTERNET LOAN AND IT WAS SOLD TO SOME COMPANY AND THE GUY HAD A DEEP INDIAN VOICE AND CALLED AND SAID THE SAME THING THAT IF I DIDNT CALL BACK THEY WOULD TAKE ME TO COURT AND PUNISH ME FOR FRAUD AND BAD CHECK WRITING AND I WOULD B PROSICUTED IN THE COUNTY I LIVE IN UNLESS I PAID THE DEBT RIGHT THEN AND SETTLE OUT OF COURT AND IF I DIDNT BAD THINGS WOULD HAPPEN LIKE WITH THE LAW HE WANTED ME TO WRITE A LETTER TO SAY I WAS GOING TO PAY IT AND NOT DISPUTE IT AND I HAD TO GET IT NOTERIZED AND THEN FAXED TO HIM AND THE DATE HE SAID I TOOK THE LOAN DIDNT MATCH WHEN I GOT THE LOAN THEN IF I ASKED QUESTIONS SO I COULD RESEARCH IT HE WOULD GET MAD AND SAY THIS IS YOUR SOCIAL # THEN IT IS YOU AND IF I DIDNT WANT TO RESOLVE IT RIGHT THEN I WOULD BE PROSICUTED AND GO TO JAIL IVE SEEN THESE COMPLAINTS ON LINE BEFORE AND ITS ALWAYS THE SAME THING A GUY WITH A HEAVY INDIAN ACCENT SAYING HES OFFICER MATTHEW ROGERS OR FRANK STIFFLER BUT ALWAYS OFFICER AND ALL HE WOULD TELL ME ABOUT THE COMPANY IS IT f c INVESTAGATIONS AND YOU CANT FIND IT ANY WHERE ON THE INTERNET PLEASE TELL ME WHAT TO DO THEY WONT STOP CALLING
