Hi...I took a loan from pay-day loan yes back in 2007..too make a long story short was going thru a nasty separation from my EX and had money problems and ended up having to change bank accts etc and defaulted on it. In April 2009, they contacted me and we sent up arrangements to pay $165 for 6 months for total of $990. I made 2 payments of $165 in May and June 2009 and then wasn't able to make the rest. I called to them to see if we could change payment terms etc and they wouldn't so they kept putting payments thru and got returned as NSF. They now have a collector...keep calling from 2 #s 213-341-4441 and that is for PA Enforcement and also from 614-586-9393...the 800# they gave for them also 1-800-403-7550 is answered as Profile Recovery Group...I finally spoke w/a Carole Martin and she told me that basically I owe them $660 balance after 2 payments and $200 in NSF charges for balance of $860 but they will settle w/me for $430, but I have to pay it all in 1 lump sum this week. She stated she sent me out paperwork to find out my income expenses and that they are going to pursue this thru the courts in Hillsborough County which is the county I am in in New Hampshire. I have not recd any paperwork (said she mailed in on 4/20)..so don't think she sent anything. I am not able to pay the full $430 she is stating I can't do a payment arrangement. Is that true and is that legal? If I am able to pay them say $50/month do they have to accept it? Any help would be great..again I am in NH...Thanks!

Send them a letter by certified return receipt mail stating what you are willing to and capable of paying! Tell them they are to contact you only through the USPS. That should by law stop the calls! Wait for there response. Just because she says that is all they will accept it does not mean that you have to accept it! Whatever arrangements you make pay them only with a prepaid debit card or by wire. Do not give them any personal account info or they could take whatever they want.

Ok so one more thing in regards to this. I just called them back and was told Carole was not in the office. I asked her if I could make a payment on Friday via Western Union or Money Gram and she said no..has to be a secured payment and told me to go get a prepaid debit card and call them back w/the #. She said they will only take payments w/checking acct, credit card or prepaid debit card. I don't get that....how is a cash payment thru Western Union not secured??? She would not give me an address for them and I can't find any info on them...2 names they go by it seems...Profile Recovery Group and PA Enforcement..does anyone have an address for them? Thanks!

done send them any money they are scam artists. You should have made them prove that you owe this debt via certified mail. Even if you owe the debt they still need to provide it in writting and that if you pay this debt you need a letter from them paid in full and with the account number or you will have no proof you paid it and other debt collectors can come after you for it again.
Make sure you have everything in writting!

I am dealing with them right now as well. I asked them to send me proof of the account and what I owe, she Carol is trying to tell me they are going to garnish my wages but they will send out the paperwork.... I live in TX and you have to have a court order to do that. I guess we'll see... I'm not giving them any personal info. at least any more than they already have.

Actually, TX is a non garnishment state BUT, what payday yes is probably referring to is a 'wage assignment', which is different from a garnishment. When you obtained this loan you probably signed something which said they could impose a wage assignment on your wages if you defaulted. That is easily remedied. All you need to do is send them an email and revoke their rights to any and all wage assignments you signed, print it out and take the copy to your employer. Done.

One thing I am sure you are aware of, but I will post anyways, is the fact that Payday Loan Yes is NOT legal in any state. So, CLICK HERE to find out how to deal with illegal lenders.

I would not pay them one penny, there is nothing they can do to you. I spoke to the Illinois Attorney General about these people and she said if a company cannot give you a physical address to make a pymnt via mail they are not legit and hiding from something. She said to tell them to take you to court, and then they will be investigated. I would not pay them anything, i bet pay day loan yes told you the same thing before these people calling.

They are illegal, no reutable company would disclose that information to a third party because it is illegal. Stand firm and tell them you will pay them nothing!!!

I have also dealt with these crooks. They threatened everything from taking me to court to garnishing my wages!! I made sure my HR Dept. had a letter revoking my VOLUNTARY wage assignment and then I begged them to take me to court - which of course never happened because they are illegal and would never do that. At this point make sure your HR Dept has a revocation of wage assignment letter and do not talk to them any longer. They are such jerks!
