I received a collection letter on a debt from 1992 in florida. I don't remember this Amoco $238.78 bill and have never been contacted about this. It did not show up on a credit report when I purchased a home in 2003. was told primary balance was 201.53. what are my rights here in florida? should i send the letter of dispute the collection agency states is necessary or just ignore this letter of collection?
thank you,
James P. Moore

Depending upon the date of last activity in this account, this account might be past the SOL period. In Florida, the debt accounts go out of the SOL period after 5 years. So, you can't be legally forced to pay it if you have not renewed the SOL by making payment in the recent times. Also, make sure that you don't sign a promissory note that can renew the SOL.

Dispute with the company in writing mentioning the expiry of the SOL. Send your letters through certified mail with return receipt requested. You should have all papers documented so that you are able to prove the facts regarding your dispute.

WOW! 14 years and it wasn't even on your credit report. Even if it was, it would have been dropped by now. Thats crazy!

Clay I have a question for you, since we're on the subject of citi group. Whats the difference between Citi and CIT?? Dell financial is in with CIT, are they one of the same, or two entirely different companies? thanks, shirley
