As long as the creditor is licensed and doing business by staying within the statute of the state, it can sue. Mostly, the storefront lenders are legal. Hence, you can be sued by a storefront lender if you default.

Regarding the online lender, please check out his licensing details in the state. Unlicensed lenders can't sue you.
