Hi, been reading all the horror stories, mine is similar. Getting calls and letters from them regarding an account that was a charge off from capital one back in 2000 or 2001. Haven't heard a peep from anyone in nearly 10 years until now. Understand i need to send a certified debt validation request , and to verify the s.o.l. Is there a form letter for this, or a link ? Appreciate any help i can get! Thanks

Hi, as the debt is charged off and its like 10 years now. So the SOL (Status of Limitation) has been expired if you have not pay them a single time. if the SOL expire you do not owe them any thing. May i know you are from which state? You can check the SOL for your state from the below link.

Actually you are still liable for the debt, they can even sue, you would have to bring up SOL defense as the court will not do this on its own. However I believe it is a 1 to bring suit on a time barred debt. But you do have the right to send a validation letter and if you are absolutely sure this debt is SOL then you can also just send them a total cease & desist letter and tell them to take a long walk off a short pier.
