Now should I ask for a minimum amount they would take to close this out or just ask for a payment plan above what I was paying previously to Scott Lowery.
I have no bank accounts, saving accounts nor do I have any joint accounts with my wife. My paychecks are more like personal checks than normal business checks. I only deal in cash and I have no landline phones either.

Since you have received summons, you must file a reply to that without fail to avoid receiving default judgment. Along with file a 'motion for discovery' to get details about the account. Ask the court clerk to assist you.

It sounds like they may be trying to say you got this account while you were married so that they can go after your spouse. What state are you in and did you open this account while you were married? If you live in a community property state and the account was opened during the marriage they may be able to go after your spouse.

Yes answer! This is imperative because if you do not, despite this not even being your account, it will become yours through a default judgment.
The summons should have a bunch of numbered statements....you can agree to the ones showing your name and address, and deny anything that even remotely suggests this card was yours.
