I posted before but cannot find the thread! Cash jar withdrew 1000.00 from my checking account. The day prior I had talked to supervisor "Anna" who arranged a settlement of 150.00 on May 7th, and two more payments (May 22 & June 7)of 200.00. I already paid them the original amount of 1000.00 but wanted to handle things honorable. The next day they took 1000.00! I was devastated. I called and they said they couldnt return the money but if she verified it cleared she would return 300.00. I was petrified of garnishment and collection so I didnt send the ACH back. 3 days later, no $300 deposit and I couldnt even put gas in my car let along pay my rent. I then went to the CU and had the ACH returned because the amount was not the authorized amount. Then, this new lady calls yesterday and offers a settlement of $600.00. I told her no. I then emailed the letter (the suggested letter in this forum) demanding the ACH cease and no contact.....
No word for them. The lady did say that if I didnt call her back by 7:00 PM last night, I would face legal problems. I verified they are not licensed in Utah. I guess they are out of belize. I filed complaints with AG's and they others that were suggested. I changed my account. Can I really be garnished and go to jail and all that?


NO, you can't be put to jail for not paying to an unlicensed pdl lender. Moreover, debt is a civil matter and its them who have stolen money from your account. So, don't panic.

Now, hope you have followed the steps mentioned in the sticky in the pdl forums about dealing with unlicensed lenders.

When the lender isn't licensed in your state, you morally owe only the principal amount to them and since you have already paid the $1000 that you have borrowed, you don't owe them a dime more.

Have you signed a voluntary wage assignment form? Then you must immediately revoke it. Inform your employer and the lender in writing.
