Friend needs advice

The income she put on the application has changed since her bro-in-law lost his job.
She has called and let them know that she can't send the same amount each month but will send $20 a month instead because that is all she can afford. She has sent these payments certified mail and they are telling her that they will decide what amount is appropriate for her to send now after she comes in and they fill out a budget with her. They are sending her payments back to her because they want more than the $20 per month. They are talking about garnishing her wages and all of the other tactics.
What should I tell her?

Dont pay them. Close bank account, open new one and let them call her until they are blue in the face!!...They are just a bunch of bottom feeders and will just make you go crazy. If they are illegal in your state there is nothing they could do. Just dont do it again. Find other ways of obtaining money loans from family, second job, tag sales, selling old jewelry...but dont fall into this mess again.

Payday loans are illegal in Texas.lenders still use out of state affiliates to make loans in order to squeeze more profit from the customers.Try to avoid it in future,repay the original principle amount as soon as possible to come out out of the trap!!!!!!!

I'm glad she has proof that she made attempts to pay them in allotments. Make sure she keeps the payments they have returned to her. Texas is a non garnishment state, however, they might be referring to 'voluntary wage assignment'. When she signed the loan contract there was probably a clause inserted which stated they could attach her wages if she defaulted on the loan, that's simple enough to resolve. Tell her to send them a letter which says she revikes their rights to any and all wage assignments she may have signed with their company, also tell her to include the fact that a copy is being presented to her employer, send it certified, return receipt requested and keep a copy of the letter. If this should ever go to court she has proof that she tried to resolve this with the returned payments, so a judge will probably do no less then award payments, which is what she was doing to begin with, so she is doing the right thing.
