I took out a loan from United Cash Loans back in October 2009 for $300 plus the $90 fee. I refinanced or rolled the loan over 4 times and then hit the paydown of $50. On February 1, 2010, I closed my bank account and told them that I consider the account paid in full since I paid above and beyond the original amount borrowed. They call me everyday, twice per day and they keep on demanding that I pay the balance of $65, which I am NOT going to do. What legal action can I take, since they continually abuse the cease and desist letter that I sent to them? I live in Arizona.


You can ask them to provide an accounting, as to why they are still asking for money. Keep in mind that when you take out a payday loan (or any other loan) you have to pay interest on the money. Also, I hate to be blunt and rude, but you are not the person who gets to determine when your loan is paid in full. If the lender has a legitimate claim to the money they can take you to court.

I refinanced the loan 4 times (4 x 90 = 360) and then I started paying the finance fee plus the paydown of $50. The balance they show is $65, but I feel I paid above and beyond the original amount borrowed. I should clarify that I requested a paid in full. I couldn't find where they are licensed to do business in Arizona, therefore I believe they are an illegal lender. Maybe I am wrong.

no you are not wrong.this is an MTE affiliate,and illegal in every sense of the word.you owe them nothing further.close your account if you already haven't.they will debit forever if you let them.

I can't find them either on the Arizona department of Finance's website. That would mean they are an illegal lender and that you don't have to pay anything more. Point out to them that you have been unable to find their business license on the Arizona Department of Finance's website, and that unless they provide you with evidence that they are licensed then you are not obligated to pay them any more.

From what I've read, this outfit isn't licensed anywhere, even in the State(s) where they're supposedly located (OK and KS?). From personal experience I know you can tell them everything about your State laws but guaranteed they'll tell you that your State government doesn't know what it's talking about!!! These guys are unbelievable - just hang up on them when they call.
