I live in Florida and opened a credit card account with a former girlfriend back in December 2000. The $5,000 limit account was sold several times and was ultimately purchased by Cache, LLC in Jan 2010. The last payment recorded on their attached billing statement shows Dec 2006 (on an affidavit); however the Cache account information report has a last payment date of 10/20/2007. The final balance showing on account is $5,294.02 and the Cache account information report shows an additional interest of $2,777.39. I am being sued for $5,294.02 plus interest, costs and attorney fees. I cannot afford an attorney. I am the only person named as Defendant. I will be representing myself and I have 20 days to respond. I do not have the money to pay this debt, nor do I want a judgment against me. What defense can I plan for to avoid a judgment? Thank you.


Have you checked the SOL of the state? My guess is that the SOL is about to expire and therefore Cache LLC has sued you in a haste. You may check out the following link for help to file your reply.

You may also file a motion for discovery which would compel them to disclose details about the debt. Check out with the court clerk for help.

Answer the complaint. There is a lot advice on this forum and other forums online on how to do that.

And, include counterclaims against CACH for their violations of FDCPA and FCRA. Such as falsely claiming a payment was made in 2007.

CACH is a lying slime JDB, and should be fought vigorously. Also complain to your state's AG about their fraud.
