Bogus AT&T Bill

AT&T sent a bogus phone bill [$227], that I know nothing about. I completed police affidavit for identity theft and other requirements directed by AT&T and sent back to them as well as their collection agency as directed. I was later contacted by the collection agency by phone that they have closed the matter as identity theft.

Months later, AT&T still sent the same bill to another collection agency who reported this as a delinquent debt on my credit and damaged my credit score and/ report.

Under FDCPA and/ FACT:

1. Do I have any right to sue AT&T and/ the collection agency that reported it to my credit history for the damage to my credit because I have been denied unsecured loan by my bank based on this negative reporting?

2. Do I have a right to have them remove this negative from my report?

3. Are there attorneys or law firms that handle this type of case pro-bono?


AT&T is not governed under the FDCPA since they are the original creditor. You would have a case for negative reporting. Was a copy of the police report sent directly to AT&T? No guarantee that the CA forwarded it.

Attornies do not handle these types of cases pro bono...they take these under contingency which means they get about 40%.
