Hi

I was evicted from my home in 2003 and recently received a letter from a collection agency that is adding 3,000.00 to the original debt because I signed a new lease for 2004. Is this legal?

Bev,

On two occasions, a collection agency can add charges to your debt account. Creditors can authorize the CA to add charges and it will be mentioned in the agreement contract. If you review the loan agreement, this point must be mentioned there. Since you have signed the paper giving your approval, it becomes valid. The rates will be mentioned in the contract.

Also, collection agencies can be authorized to collect permissible charges as per the statutes in each state. Visit your local AG's office and know the permissible charges that collectors can take on the total amount of debt.

Any of the two given situations authorizes the collectors to collect the debt with additional charges.
