UCB attempting to add fees/interest to a debt paid 7 years ago
Date: Wed, 06/02/2010 - 14:24
So the original fines are paid & they even acknowledge that payment. Interesting how they didn't acknowledge it in the original letter & tried to get me to pay $186.40. But now 7 years later UCB is trying to charge me finance charges & a collection fee! If I remember correctly, I didn't even deal with UCB 7 years ago. The letter was from the State Attorney's office or something like that & I immediately paid it.
I'm waiting for a response from the Bursar's office at MU. They responded to my original e-mail & asked for some additional information. What response would you send to UCB at this time? Is there a template to say they didn't validate that they owned the debt & I dispute that I owe them any money?
Thanks for any help!

There are two templates of validation responses (if the creditor didn't respond) you can use in the DIY section under forms. They're called debt validation follow-ups.

WOW, and debt collectors wonder why people think they are ignorant.....

Yep, that's what I'm saying. It was paid until they tacked on interest & fees. The parking fines & interest came to $99. I made a $99 payment in 2003. So no balance until they add on these fees May 25, 2010.

The very first thing I would do is get back in touch with the school, I see that youre waiting to hear back from them on this. Here's the thing--this debt collector got your info and this "debt" one of two ways.....either the school contracted with them to collect it or they are illegally trying to get money from you without permissable purpose. The first thing I would do is find out which one it is. If the school contracted with them to collect it, then I would point out to the school that even in their own records this was paid in full years ago. If the school insists in trying to get this additional amount collected, I would inform them that they will be facing a lawsuit if they choose to continue this illegal and very fraudulent harassment. That will probably be enough to get them to get a clue. If it isnt, then fire a lawsuit in their path and see what happens when they realize that they will now have to pay YOU for their incompetence.
if the school did NOT either hire UCB or sell the "debt" to them, then UCB is committing the fraud. The goal here is to see who exactly messed up....because until you find out who did, this cannot get resolved. If UCB is fraudulently trying to collect a "debt" that they were not hired or assigned to collect, then that is your target. And in their case, I dont even know if I would give them the courtesy of telling them they are facing a lawsuit, I would probably just file the lawsuit and let it speak for itself.

UCB is collecting on behalf of the school. The OP paid the fines originally but failed to pay the mandated and agreed upon collection fees to the schools. I answered this in a duplciate thread. Bursars office at the school is not the same as the collection office...each is capable of billing and putting on holds. The OP probably did not contact the collection office where the collection fees were applied.
Not that I am a big fan of UCB but I do know they do handle accounts for several florida schools. No fraud, the debt was validated. Plus no SOL...state school, state debt.

Miami U is in OH, not Florida.
UCB sent me a statement which appears to be from the Bursar's office, which is why I started with them. The person who e-mailed me back asked for my address & phone number, which I provided him. Both are items UCB already has because I called them when I initially received the letter.
I paid the amount I was billed in 2003, including interest on the fines, so I did not fail to pay anything.
The date of these new charges is 5/26/10.
I am not trying to get out of paying anything that I legitimately owe. I was surprised in 2003 to get the fines due letter. I worked at Miami U & parking fines were always deducted from my paycheck. The last fine was in Feb. 2002 & I left in May 2002. I don't know why the outstanding fines weren't deducted. But they weren't & I owed them, so I paid the fines & the interest they said I owed. But this to come about now, 7 years later when the statute of limitation is about to expire makes me suspicious. As well as the first letter from UCB did not acknowledge that I paid a penny towards these fines. But once I asked for verification, oh yeah, you paid the $99 but now here are some new charges. The new charges sound like a way to re-age the debt.

There is no statutue of limitations on this type of debt.....call the collections department.
Matter resolved!
I talked to the Bursar's office & resolved the matter. Collections is a part of the Bursar's office, so I was talking to the correct person & department. The OAG, who I paid in 2003, did not report the payment. So the collection agency was trying to collect interest. Even once they got an updated statement, they were trying to collect the same interest. He also mentioned they were trying to charge 30% instead of the allowed 10%. The balance has been corrected to $0. I will receive a letter in the mail in the next few days indicating such.
If I had just accepted the Collection agency's first letter & paid, I'd be out $168.40. Instead I pursued the matter & am out nothing.
