2 Weeks of Hell
On May 13 my wife received a phone call at home from Brandy at NRC stating I have a past due balance with a pay day loan company. She then wanted my contact information. My wife immediately called me and I called Brandy back within a few minutes. She expressed that I owed $750 but they were willing to settle for $350 and they needed to make arrangements right then and there. I asked her for proof of the loan and she told me I would need to contact my bank. I explained I closed the bank account 3 years ago and have no way of getting that information. (Never read the mini Miranda) I told here I would call her back. I called her back the next business day. Once again the never read the mini Miranda. I also received an email saying I owed money but never explained the debt that I owed. I was feeling bullied and I went ahead and post dated the settlement for the 28th. They tried to run it the very next day and I received a phone call stating that my payment did not go through. I remember our original conversation and I told here I wanted the money debited on the 31 but she said no because it was a holiday so she would deducted it on the 28th. Anyway I reminded her of the conversation we had and she said she did not recall having but she went ahead and set up the payment. This was 2 weeks away and something was not sitting right with me. I called the original debtor and they said the loan was for $300 and was sold. This loan is over 3 years old and it was from May of 2007. I made sure the money was not in the account for them to debit. Never once did they read me the mini Miranda and prove to me what was added on to the charges. They tried to deduct the money and I received a very nasty phone call. 1st they tried to deduct 400.87 not the $350 I was verbally told in the settlement. She told me this was for the 2 accounts I had with them as well as the service fees. I was only notified of the one account. When I began to ask questions of Brandy she became extremely upset and had me speak with Mike Powell. This guy was the meanest jerk I have ever spoken with in my life. He tried everything in his power to bully me into making the payment by the end of the business day or he would ???Prosecute??? I simply wanted an explanation of the extra charges of why a $300 PDL was costing me $750 or $400 to settle. I asked him about reading the mini Miranda and his reply was ???Are you kidding me???? He also stated that he needed to get the money over to his client tonight. (They own the debt they are the client). I was quite upset and began yelling as well. I asked him if I could see paperwork from the original debtor or speak with them and his reply ???Not going to happen.??? I was threatened to be sued. When we both realized that the yelling match ???phone call??? was not going anywhere he ended the call by reading my mini Miranda and then followed up with ???you do understand what the means???? I immediately called the original debtor and found out they the sold the debt off and the original loan was for $300 and I had paid interest on it several times. I admit I most likely owe them money but there were way to many red flags here. This morning I sent a letter via email and fax to the company as well as directly to Mike Powell stating
This is not a request for "verification" or proof of my mailing address, but a request for Validation of Debt made pursuant to the above Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.
Please provide me with the following:
1. What the money you say I owe is for
2. Explain and show me how you calculated what you say I owe
3. Provide me with copies of any papers that show I agreed to pay what you say I owe
4. Provide a verification or copy of any judgment if applicable
5. Identify the original creditor
6. Prove the Statute of Limitations has not expired on this account
7. Show me that you are licensed to collect in my state
8. Provide me with your license numbers and Registered Agent
Also asking all phone calls to myself and place of employment stop immediately. Any other suggestions. I have paid several PDL???s loans off but something is not sitting right with this company. Also I have 30 days to contest the debt correct? One other interesting piece of info I forgot. It says Malicious Web Sites are filtered. Same with my Itouch.

did you file a police report for the initial call.if not do so.also file AG,and FTC complaints against both the bottomfeeder pdl,and the bottomfeeder collector.i read your post,and am gonna guess that you not only don't owe the loan,but the pdl owed you a refund,and sold it to the bottomfeeder because they didn't want to deal with a possible refund request.file the report and complaints.then disregard them.

I have not filed a complaint or a police report. I will defiantly file the complaint to the AG and the FTC tonight. What benefit is it to file a police report?
