I tried telling the Rep about my hardship problems.

At one point, Rep went nasty and basically accused me of making recent charges knowing I was financially burdened. I asked if he was accusing me of making fraudulent charges. Then the guy went nuts and was talking over me and lecturing me about how I made an agreement to pay Discover. I told him I did not have to listen this and said conversation is over and hung up.

Will this guy at Discover flag my account for litigation or send it to collections immediately? It is only 45 days late. Just want to be sure this Rep will not screw my settlement chances.


Wow that's pretty aggressive for only 45 days late. my guess is you caught a guy in a bad mood and he vented on you. I'm not sure what bearing rep notes in the system do to the file. I can tell you that at this point you are still in house and my cousin worked there and they are very very strict with FDCPA stuff. So you could call back in and tell whoever answered you want to speak to a supervisor about the conduct of a collector.

On another note, if you have been charging and you want to immediately settle that would be a problem. All of my cards were relatively easy to settle but they hadn't been used in a year or two. So if they won't settle it may not be related to this call, but due to the recent activity on the account.

i've gotten in 2 verbal arguments with discover over the past 3 days about my account. the first was cause they skip traced my parents cause i didn't answer the 2 times they called that day (please note i have taken 90% of the rest of the calls) and ripped them a new one about calling them. and they called again this morning and i told them that nothing has changed and to make a note that they got in touch with me. she said she would not make a note if i didn't tell her what was going on. i told her to read the notes from the past 3 months. she said there are a million notes on this account. i told her she better start readin then and hung up.

now i have a little different situation where in im in the process of filing for chapter 7. the only reason im not telling them is i don't want them to unload it to a collection agency real quick and get something out of it.

i have had several shouting matches with BOA over the last 2 + years, even way before the reform was even being considered. some reps are nice, some reps are nasty. if they recorded conversations like collection agencies do, they would have came after me regardless that i was paying my bills on time.
them calling you and then blasting you- i would report them to ftc and consumer affairs dept. we had that deal with our discover cards too,but with no minimum purchase, just a purchase was all. it had an expire date, so we kept it up til the offer was no longer in play. they never raised our rates, and never lowered our limit.
