Don't believe anyone who says they're suing you until you get a knock on the door from a process server with a summons to your local court. Send them a verification letter via certified mail and if they won't verify refuse to speak to them.

Hi, I have also received calls from them and they actually wanted me to submit payment via my debit card... I have never received notices from them or any emails as they claimed they have sent, and they threatened to sue me.

It is ironic, to say the least, when someone who takes out a payday loan and defaults,on said loan,calls someone who tries to collect on money deposited into their bank account a bottom feeder. Lets consider some facts. In some states payday loans are illegal. A quick and simple breakdown of these types of accounts is simple. Roughly 20% of the people who use these services are drug addicts and the true bottom feeders, another 20% had a legitimate hardship and needed emergency funds. The remainder typically fell for a flashy banner ad or Google advertisement that makes it sound simple and cheap. I would also estimate that nearly 80% did not bother to read the terms and conditions or privacy policy. It is a contract no matter how you look at it and funds were deposited into a bank account with the intention of making a profit off from the interest for the loan.
How anyone can claim ignorance as an excuse for a high interest loan is baffling. Try telling a cop you didn't know the speed limit and see if that works. These debts are valid. I agree, payday loans are ridiculous. The interest is borderline criminal but they do adhere to the letter of the law or they would not be a multibillion dollar industry. The chain of title is clear, as a previous poster indicated "they don't own the debt", this is true they are providing a service and also protecting the portfolio, exactly the same way a mortgage lender does, by verifying and validating information to determine if a legal venue is the best approach.
As this debt is valid it will go through a series of collection efforts and then will be reviewed to determine if pursuing a judgment is the best course of action. All types of debt go through a similar process. These are difficult economic times for both business and consumer. Someone will pay and if these do go for a judgment it is a slam dunk in most cases. The amount of information gathered during the application process is staggering. Validating the debt is what a pre-legal servicing company does. The terms and conditions on these paydays, as they are done online in most cases, do not require the same validation process as a credit card where you physically signed the documents. For and example of Terms and Conditions check out one of the big player like Cash Jar or Cash Net. They will tell you if the loans are legal in your state, they will define the exact amount of money you will be charged and what to expect if you default. It is not a mystery if you are literate.
Now the irony, often times they would prefer to settle for the original amount of the loan plus collection costs. What a bunch of dirt bags. They actually want the money back they loaned you. If you also consider how the industry works, read the fine print, you would know that many of these payday loan companies are owned by legitimate corporations. They leave the less consumer friendly portions to a smaller company to do all the work on a contingency basis while maintaining chain of title and the right to sue or collect in any legal fashion possible. Currently 40% of all payday loans go into default before any portion of the principle is paid back. I referred earlier to a couple big players, Cash Jar and Cash Net(No Affiliation to Ross & Crim just an example), if you do some homework you will see that they can be traced back to a company that is publicly listed and you may even have shares of one of these companies in your 401k.
I am not looking to get bashed. I agree payday loans can be ridiculous, especially if you do not pay it back in full on your first paycheck. I also agree that their are dirt bag collection agencies and individual collectors that can desecrate the reputation of a good company. It is also unfortunate that the vocal minority, the 20% i referred to earlier spend more time and effort besmirching the reputation of a company that has worked with thousands to resolve these accounts. I know for a fact that Ross and Crim does not pay a commission to their employees. They are salaried individual that review the materials presented and hand them back to an ownership group. Obviously attorneys are a part of the collection industry. It is far to lucrative for them to pass up. For every Attorney that is out there suing for FDCPA violations there is another out there suing debtors for legitimate debt.
In a country that is drowning in debt, I know it is an almost ridiculous notion for someone to assume the responsibility of there actions but paying your debt back after determining a fair amount is far from crazy and I would call it the right thing to do.
I am surely in the minority but I would like to see more people pay cash and all the payday loan companies dry up because the economy has returned to a cash based system. These loans are an absolute last resort and should never be sought out for anything short of desperation.
I wish you all the best and hope you find your way back to financial stability. Please remember that for every bad collector there is a pro debtor that will post 20 negative statements over 1 $250 account.

I am sure most will proclaim I am a lackey or employee. I am neither, I have encountered them in the industry and my assessment is that of a group of educated and professional individuals that do there jobs well. Is it possible an agent got out of line and/or let his/her emotions get the best of him and responded in a negative fashion, absolutely. But I ask that you also consider the treatment that many of these agents encounter when they are simply trying to do there job and get this situation resolved prior to any litigation. I assure you, and I know first hand, people on these boards will always claim that you will never get sued. It would be insane to think that the lawyers wouldn't find a way to make money in the collections world when the shear volume of debt in this country makes it impossible to pass up. They can make 100 times more money working on these collections than defending speeding tickets. Don't be ignorant, read the fine print and never take out a payday loan unless you are certain you can pay it back on your very next payday. Believe it or not, some are actually happy to fulfill their obligation. Many of these sites paint the consumer as uneducated buffoons who got screwed while many of them are exactly as I stated, good people who had a hard time and want to make it right. It is not right to take advantage of someone who encountered a hardship but it is also not right to fail to meet your contractual obligation. Take care.

Have you actually read the terms and conditions on any of these payday loans or are you simply riding on the laurels of your University of Phoenix degree. As there is no paper contract the validation process is completely different. Before trolling for clients you may want to check out the ACA and keep yourself abreast of the contracts you are disputing. I am sure you will do well in finding FDCPA violators and suing for pocket change, in the grand scheme the lawyers on the other side, endorsing the collections side are making far more money. I work with them on a daily basis and know the game.
No offense, just do some homework and please don't regurgitate a bunch of crap that will sound official but mean nothing. The bottom line is money and if you are an Attorney, unless you are pro bono, then you will soon realize if you are part of the collection side you will find it much more lucrative and you can use your skills to make sure compliance is adhered to and consumers are treated fairly while the business that this country was founded on can return us all to better days. 1)ross and crim are a collection agency and not a law firm.
2)that being said it is illegal to threaten a lawsuit when you can't do it.
3)the fact that QUICKEST CASH is part of MTE makes the "contractual obligation" void,and the person is only liable for the principle.
4)why oh why won't this peice of NY trash collector send something which is required under the FDCPA.

Of course, validation of debt is required. If anyone had bothered to read the complete posting they would know that I wrote that. Quickest Cash nor MTE was ever mentioned during reply nor did, at any point, I state anyone was collecting anything other than the principal. Typical response from the forum. Blame the big bad collectors for not paying your bill and for the record I don't work on phones, but even if I did it would still be better than most of the people who look for semantics as a way to avoid paying someone back money they borrowed. These "deadbeats" are what are wrong with this country, not the collectors that actually get up and go to work everyday and pay their bills.

Actually, the place collects for approximately 60 different payday lenders that fall under numerous corporate umbrellas. As stated, I am not a fan of the payday nor am I am fan a someone having money deposited into their account never to repay a dime. Based on your syntax you are clearly an educated individual, please explain how that type of default is justifiable in any context. BTW, I am an engineer, not a collector. Somebody has to coordinate the database and contrary to idle rantings there are strict guidelines and regulations to adhere to.
If you are truly looking for a solution call in and mention this forum. I will notify them there may be issues that need to be resolved and some unknown poster requires validation of debt. I guarantee it is provided to the letter of the contract and in a timely fashion. I am sure a place to rant is more in line with what people are looking for but if a solution is desired it shall be granted. Take care

I would say getting a DL# correct is pretty important in trying to present a solid case. Second of all, our "agent" referred to Judge Judy & many other tv court shows in her dialogue with my husband. Thirdly, she recited many names I would never use as a referrence (such as an ex-husband) and many others I had never heard of. Her best argument was to hang up on my husband when he simply requested she repeat the DL# she had on file. Ross & Crimm is unprofessional, at best, in many way.

I understand you are trying to collect money but first of all try to be a little understanding and realize right now the economy is BAD and if I do not have at this time to pay its a pain to constantly try to talk to them. They always say about suing but they are just trying to scare you.
