I rec'd a summons by a local atty for Citibank that I am being sued for credit card debt. We signed with a debt resolution company a few months ago who sent notice to Citibank. We have only made 3 mos payments to debt res company so there is not enough to negotiate, even if they would. I am not sure how to answer summons, was told to dispute amount. I have also read of asking for dismissal, can't afford atty, not sure what to do or what to expect next even if I answer summons. Has anyone been through this process?


This is a common problem when trying to do debt settlement thru a 3rd party....they 3rd party gets paid first and your debt waits...which gives citibank the time to sue you.

Since it is Citibank sueing you, they can easily prove the debt and amount.The amount you are being sued for will be significantly higher since court and attorney fees are now added in.

On what grounds for a dismissal?

Okay - you need to answer the summons, but you must also call citibank or the attorney and try to work out monthly terms on the debt. Once arrangements are made they will drop the lawsuit and prevent a possible wage garnishment (if allowed in your state)

If you can't afford an attorney to to your local Legal Aid Office and they will help you.
