BOA choice of law provision

I'm trying to understand more about the choice of law provisions that are in some cardmember agreements.

Does it have to be on the original cardmember agreement or at some point and time later if they added it, can it then be used?


Thank you so much! I've been doing some reading about Steven J. Pincus v. The Law Offices of Erskine & Fleisher, et al., Case No. 08-CV-81357 and wondering if your state has a choice of law, why more people don't use it and choose the Delaware as the governing state for their credit card agreements for the ones that do have that wording on the cardmember agreements. It just seems that if it does indeed say that, then looks like the courts would honor it.
